Fish Welfare and The Council of Europe
  • 47 Member countries in the Council
  • The Standing Committee of the European Convention
    for the Protection of animals kept for Farming
    Purposes (T-AP) deals with animal welfare -
    including fish in its brief.
  • Unanimous decisions required to issue
    Recommendations which, later on, are often
    incorporated into EU law.

Composition of the Standing Committee
  • Representatives of the Member countries of the
    Council of Europe who vote on decisions
  • Scientific experts nominated by the Member
    Countries
  • Experts from International Organisations
    representing either Non Governmental
    Organisations (often animal protection oriented)
    or the Industry (Vets, producers) non voting

How is FEAP involved ?
  • Through its members
  • National associations usually work with the
    Representative and the Experts of their own
    Country (but not always possible)
  • National associations decide on a common position
    which FEAP defends on behalf of the whole
    industry
  • By attending the C of E meetings as
    representative of the Industry (via a seat held
    through COPA-COGECA)

Fish Welfare when did it start? where are we up
to?
  • Years of discussions In 1997, UK proposed a
    draft recommendation based on the report on the
    Welfare of Farmed Fish by the FAWC, 15 versions
    of the text later
  • A final version of a general Recommendation
    concerning Farmed Fish ratified in Dec 05,
    implemented on 5th June 06
  • Annexes on emergency slaughter and individual
    species (at various stages of discussion)

What have we achieved?
  • The industry agrees that fish welfare is an
    important element of Sustainable fish farming
  • But hard battles had to be fought and are
    continuing - simply to establish the real facts
    on many issues such as Fish and pain, Density
    only to be used in relation to other parameters,
    emergency slaughter, starvation period,
    differences between species and between
    geographical regions.
  • Without FEAPs involvement, some of the elements
    proposed in the recommendation would have simply
    blocked or even eliminated fish farming in
    Europe, had they become compulsory at a later
    stage.

The Council Directive on Aquatic Animal Health
  • The project was initiated in 2000
  • From 2001 onwards, FEAP was regularly consulted
    by DG Sanco. There were
  • Written consultations
  • Bilateral meetings with the desk officer in
    charge of the project
  • Regular updates in the ACFA meetings
  • Stakeholders consultation

Overall objectives
  • To raise the fish health awareness everywhere in
    Europe - including in pond farming
  • At the same time, to remain practical and keep a
    fair balance between free trade and health
    protection
  • To have a simpler legislation, more flexible, and
    easier to implement

Main characteristics
  • All farms to be licensed and categorised
    according to health status for each listed
    disease
  • Keep in line as much as possible with OIE
  • Annexes to be easier to modify (including list of
    notifiable diseases)
  • Financial compensation when compulsory
    eradication imposed

The down-side!
  • In spite of the consultations and debates, FEAP
    felt, by 2004, that the proposed text was not
    fulfilling the original targets
  • The text was introducing more trade barriers
  • It was onerous, for the Industry and the Member
    States
  • It was complicated, unworkable and raised concern
    with both the Member States and the industry.

To be firm when needs be !
  • At its 2004 AGM, FEAP passed a resolution to
    alert DG Sanco on the importance of breaking the
    deadlock reached in the discussions.
  • The Directive was finally voted in 2006 in a
    version quite close to the original objectives.
  • It is now at the stage of being translated by the
    Member States into their national legislation
  • Some points, which could lead to modifications in
    some of the annexes, are still being discussed.

The strengths of FEAP
  • FEAP both allows and requires its national member
    associations to discuss every matter of
    importance to the industry and come to a
    consensual position whenever possible.
  • FEAP can then talk to the EU, the C of E or other
    bodies with one single position for the whole of
    European Aquaculture, which gives the weight and
    credibility needed by our sector.
