Whereas 12 ... the use of these
internationally agreed normative documents can be
an alternative to the use of harmonised standards
and, under specific conditions, give rise to a
presumption of conformity. Article 4 -
Definitions (i) normative document means a
document containing technical specifications
adopted by the Organisation Internationale de
Métrologie Légale (OIML), subject to the
procedure stipulated in Article 16(1).

Article 16 - Functions of the Measuring
Instruments Committee 1. On request by a Member
State or on its own initiative, the Commission,
acting in accordance with the procedure referred
to in Article 15(2) , may take any appropriate
measure to (a) identify normative documents
drawn up by OIML and, in a list, indicate the
parts thereof compliance with which gives rise to
a presumption of conformity with the
corresponding essential requirements of this
Directive (b) publish the references of the
normative documents and the list referred to in
point (a) in the Official Journal of the European
Union, C series.

Article 13 - Harmonised standards and normative
documents ... 2. Member States shall presume
conformity with the essential requirements
referred to in Annex I and in the relevant
instrument-specific Annexes in respect of a
measuring instrument that complies with the
corresponding parts of the normative documents
and lists referred to in Article 16(1)(a), the
references in respect of which have been
published in the Official Journal of the European
Union, C series.
7OIML Mutual Acceptance Arrangement
- Framework document adopted at the 38th CIML
Meeting in 2003 - Each category of the OIML Certificate System may
be the object of a Declaration of Mutual
Confidence (DoMC) - Participants in a DoMC may be
- OIML Issuing Authorities
- National Type Approval Authorities
- Participants accept to utilize OIML Test Reports
issued by participating OIML Issuing Authorities,
and additional test reports related to certain
specific national additional requirements.
8OIML Mutual Acceptance Arrangement
- Participants who issue test reports under a DoMC
shall declare their test capabilities and their
compliance with ISO 17025, using checklists. - Confidence is established
- either by accreditation (by a signatory of ILAC's
MRA), - or by peer assessment
- Accreditation and peer assessment will be based
on ISO 17025. - For each DoMC, a Committee on Participation
Review (CPR) will be established, review the
accreditations, monitor the peer assessments and
report to Participants.
9OIML Mutual Acceptance Arrangement
The BIML will participate in the CPRs, ensure
consistency, try to solve eventual disputes,
record the capabilities of Participants and will
keep and publish a record of the test reports
issued under each DoMC. An additional staff
member will be recruited at the BIML from 1st
January 2005, to take care of the MAA
implementation.
10OIML Mutual Acceptance Arrangement
- To be discussed and decided by the CIML in
October - Issuing Authorities will pay fees to the BIML for
balancing the costs resulting from its new tasks - a fixed annual fee (about 1200 ) for each
participation in a DoMC, - plus a fee (about 150 ) for each OIML
Certificate issued under the DoMCs - When a DoMC is signed
- participating Issuing Authorities will issue all
their OIML Certificates for this category
according to the rules of the DOMC, - after a transition period, non participating
Issuing Authorities will be delisted for this
category.

- Declarations of Mutual Confidence will start with
the two following categories - R 60 Load Cells
- R 76 Non Automatic Weighing Instruments
- Bodies willing to be Participants (and specially
Issuing Authorities) will be invited to start
preparing their application, - A meeting will be organized at the beginning of
2005 to set up the Committees on Participation
Review and to prepare the signature of these DoMCs

ANNEX B - TYPE EXAMINATION 3. The application for
type examination shall be lodged by the
manufacturer with a notified body of his
choice. The application shall include ... - the
supporting evidence for the adequacy of the
technical design of those parts of the measuring
instrument for which no specimens are required.
This supporting evidence ... shall include, where
necessary, the results of tests carried out by
the appropriate laboratory of the manufacturer,
or by another testing laboratory on his behalf
and under his responsibility.

ANNEX B - TYPE EXAMINATION 2. Type examination
may be carried out in either of the following
manners. The notified body decides on the
appropriate manner and the specimens
required ... (c) assessment of the adequacy of
the technical design of the measuring instrument
through examination of the technical
documentation and supporting evidence referred to
in paragraph 3, without examination of a specimen.
