Project Proposal

• No federal nexus for an Environmental Impact
  Assessment
• Pile technology will not trigger Clean Water Act
• Land is state-owned no federal land involved
• No federal money involved all privately funded
• Current alignment and construction design avoids
  major wetlands impact

Review ProcessForestry, Fire and State Lands

• Land belongs to the State of Utah, administered
  by the Division of Forestry, Fire and State Lands
• If approved, the state will enter into a special
  use lease agreement with Utah Crossing to
  permit the use
• Analysis of public trust, financial structural
  integrity, environmental impacts, highest and
  best use
