Title: LUC Implementation at Active Installations
1LUC ImplementationatActive Installations
- AMC Office of Command Counsel
- 13 November 2003
2Discussion Topics
- Navy Principles
- ANAD LUC SOP
- TEAD LUC RD Plan
- Future LUC Implementation
3Navy/EPA Principles
- Navy/EPA Principles
- EPA and Navy developed general LUC implementation
principles - Record of Decision
- ROD should describe LUC Objectives
- Explain why LUCs are necessary (risk exposure
assumptions and reasonably anticipated land use) - Describe area covered by the LUC (including a
map) - Provide expected duration of the LUCs
- Identify entities responsible for implementing,
monitoring, reporting on and enforcing LUCs - ROD will refer to the RD Plan for implementation
actions
4Navy/EPA Principles
- RD Plan
- RD Plan is a primary document
- RD Plan will include implementation actions -
- Periodic monitoring (frequency based on site
conditions) - Reporting inspection results
- Notify regulators prior to changes in risk,
remedy, or land use (including any LUC failures
with corrective action) - LUC Site Map
- CERCLA 5 Year review
5Navy/EPA Principles
- Guidance for Active Bases
- Navy will develop internal policies on LUC
monitoring, reporting, and enforcement to
institutionalize LUC management (consult with EPA
14 days prior to changing these policies) - Develop a comprehensive list of LUC sites and
expected duration - Notify regulators of planned property conveyances
(including leases, easements, and other partial
interests) - Obtain regulator concurrence before modifying or
terminating LUC objectives or mechanisms - If there is a failure to complete LUC
implementation actions at an active base, EPA
Region will notify the installation and seek
immediate action.
6Navy/EPA Principles
- Newsome Guidance dated 23 Oct 2003 -
- Army supports the Navy/EPA Principles
- OSD 72 hour is generally not required on ROD/RD
Plans that follow Navy/EPA Principles
7ANAD LUC SOP
- Background Information
- Active Installation with a signed FFA
- Good LUC SOP test case
- Active environmental restoration program
- Lots of land use restrictions
- LUC SOP
- Installation commander has responsibility to
ensure safety of work force - ANAD requested regulator comments but not
regulator approval - LUC SOP based on EPA Region 4 LUCIP approach
- A copy of the ANAD LUC SOP is available at
https//www.denix.osd.mil/denix/DOD/Working/LUCW/
ana_dpt_lucsop.pdf
8ANAD LUC SOP
- LUC SOP
- Section 1 - Purpose and scope
- Section 2 - Responsible Organizations
- IRP Manager is key player (training,
monitoring/inspection, reporting, and record
management) - Other organizations
- Real Property Planning Board (Master Plan, New
construction NEPA, and Dig Permit program) - Law Enforcement and Safety (Informal Monitoring)
- Other organizations (Employee training,
compliance, and reporting)
9ANAD LUC SOP
- Section 3 - Land Use Restrictions
- Land use restrictions -
- Industrial Land Use Only
- Soil Excavation Restrictions -
- GW Restriction
- Land use restriction maps
- Summarizes all restrictions
- Key to successful program (training, monitoring,
etc.) - LUC Table - summarizes restrictions mechanisms
- LUCIP
- Each OU has a LUCIP
- LUC Map and Table are probably sufficient
10ANAD LUC SOP
- Section 4 - LUC Mechanisms
- Physical Mechanisms
- Fencing
- Site Markings (warning signs)
- Administrative Mechanisms
- Training - overview of restrictions and
procedures for preventing reporting land use
restriction violations - General Workforce Awareness
- Designated supervisors
- Employee - Security, Safety, and Public Works
- Annual refresher training
- List of personnel who received training
11ANAD LUC SOP
- Section 4 - LUC Mechanisms (contd)
- Land Use Planning
- Real Property Master Plan
- Site Approval Review
- Real Property Planning Board reviews
- New construction NEPA
- Dig Permit Program - to be established
- Monitoring/Inspection Program
- Informal Monitoring - IRP Manager and Law
Enforcement/Safety personnel - Annual inspection report - signed by commander
provided to regulators for info purposes - Five year review
12ANAD - LUC SOP
- Section 4 - LUC Mechanisms (contd)
- Corrective action - upon discovery of a LUC
restriction violation - - Notify installation commander
- Take appropriate action to restore integrity of
the LUC and prevent future violations - Reporting
- IRP Manager notify regulators of land use
restriction violation within 30 days - Period repairs (damage to fences, warning signs)
are routine maintenance - Records Management (Master Plan, Admin Record
file, and web-based GIS).
13ANAD - LUC SOP
- Appendix A - Inspection Checklist
- LUC SOP, LUCIPs, and GIS Maps
- Employee Awareness/Training
- Dig permit program established?
- LUC Site Inspections
- All LUC sites inspected?
- Land use restrictions observed?
- If yes, describe corrective action.
14ANAD - LUC SOP
- Conclusion
- ANAD is taking responsibility for LUC
implementation - Good identification of land use restrictions
(maps) - Integrate LUC implementation into existing
programs - Awareness training (newspaper and weekly
television show) - Informal monitoring by Security and Safety
personnel - Dig permit program
- Commander involvement (signs reports, notified of
LUC violations)
15TEAD RD Plan
- TEAD RD Plan -
- Background Information
- OSD 72 Hour review completed
- TEAD/EPA negotiations ongoing
- Good starting point for other active installation
- Short and simple 3 pages plus a map
- Major issues
- Modification or termination of LUC Mechanisms
- LUC Mechanisms v. Other Protective Measures
- Description of the RPPB process
16TEAD LUC ROD
- ROD Language
- The land use control objectives
- 1. Prevent future residential activities
and - 2. Prevent access to and use of the groundwater
without prior Army and EPA approval. - The Army shall implement, maintain, monitor,
report on, and enforce the land use restrictions
according to the Remedial Design (RD) Plan. - Duration - LUCs shall be maintained until the
concentrations of hazardous substances at the
Site are reduced to levels that allow for
unlimited exposure and unrestricted use. - Modifications - If the Army, EPA, and UDEQ
conclude that a Site is subsequently remediated
to unrestricted use, LUCs will be removed by
revising the Remedial Design (RD) Plan.
17TEAD RD Plan

1 The Army shall consult with and obtain
concurrence from the EPA and State regulator 14
days prior to modification or termination of a
LUC Objective or Mechanism or any proposed land
use change inconsistent with the LUC Objectives
or selected remedy. The installation will
provide written notification to the EPA and State
regulator 60 days prior to leasing or
transferring installation property and consult on
specific wording for lease or transfer documents
related to the LUC Objectives.
23Other Protective Measures1Table
1 The Other Protective Measures are
installation programs that limit the potential
for LUC Objective violations but are not part of
the Installation Restoration Program. The Army
shall notify EPA and the State regulator of any
changes to the Other Protective Measures as part
of the annual inspection report.
24Conclusion
- Navy Principles
- Army supports Navy Principles
- If we follow EPA/Navy Principles, then generally
no requirement for OSD 72 hour review - ANAD LUC SOP
- Good example of LUC implementation at a busy
installation - Make LUC Implementation a part of normal
operations - TEAD LUC ROD
- Lean ROD LUC language
- LUC Mechanism modification issue
- LUC Mechanisms integral to the IRP
- Other Protective Measures not integral to IRP
- Future LUC Implementation
- Treat LUCs just like any other part of the remedy
- LUC Objective Map
- LUC Mechanism Table
