Navy/EPA Principles

  • Navy will develop internal policies on LUC
    monitoring, reporting, and enforcement to
    institutionalize LUC management (consult with EPA
    14 days prior to changing these policies)

    expected duration
  • Notify regulators of planned property conveyances
    (including leases, easements, and other partial
    interests)

  • The Army shall implement, maintain, monitor,
    report on, and enforce the land use restrictions
    according to the Remedial Design (RD) Plan.
  • Duration - LUCs shall be maintained until the
    concentrations of hazardous substances at the
    Site are reduced to levels that allow for
    unlimited exposure and unrestricted use.
  • Modifications - If the Army, EPA, and UDEQ
    conclude that a Site is subsequently remediated
    to unrestricted use, LUCs will be removed by
    revising the Remedial Design (RD) Plan.

1 The Army shall consult with and obtain
concurrence from the EPA and State regulator 14
days prior to modification or termination of a
LUC Objective or Mechanism or any proposed land
use change inconsistent with the LUC Objectives
or selected remedy. The installation will
provide written notification to the EPA and State
regulator 60 days prior to leasing or
transferring installation property and consult on
specific wording for lease or transfer documents
related to the LUC Objectives.

1 The Other Protective Measures are
installation programs that limit the potential
for LUC Objective violations but are not part of
the Installation Restoration Program. The Army
shall notify EPA and the State regulator of any
changes to the Other Protective Measures as part
of the annual inspection report.
