5EU BSS Art. 19, Art.20 The implementation of the
requirements for the controlled/supervised area
will be carried out under the responsibility of
the undertaking following consultations with the
approved occupational health services or the
qualified experts Art.23 2. Member States shall
require the undertaking to consult the qualified
experts or the approved occupational health
services on the examination and testing of
protective devices and measuring instruments
comprising in particular (a) prior critical
examination of plans for installations from the
point of view of radiation protection (b) the
acceptance into service of new or modified
sources from the point of view of radiation
protection (c) regular checking of the
effectiveness of protective devices and
techniques (d) regular calibration of measuring
instruments and regular checking that they are
serviceable and correctly use
1.3.Some articles of the EU BSS should be revised
in order to avoid the implication of the approved
occupational health services in matters of
measures for the restriction of exposures and
limitation of doses
- RPEs Duties
- The primary duty of the RPE is to provide the
employer with professional advice to users of
radiation on a wide range of radiation protection
matters. This will include advice on - plans for new installations and the acceptance
into service of new or modified sources of
ionising radiation in relation to any engineering
controls, design features, safety features and
warning devices provided to restrict exposure to
ionising radiation - the classification of controlled and supervised
areas - the classification of workers
- the content of area and personal monitoring
programmes - the appropriate radiation monitoring
instrumentation to be used - the appropriate methods of personal dosimetry
- the adequacy of current arrangements to restrict
exposure - radioactive waste disposal requirements.
61.4.The competence of the RPE should be
recognized for a specific field of expertise
The purpose of the recognition system should
give employers confidence that the person
recognized as an RPE has the core competence in
giving advice in the range of radiation
protection applicable to the activity he intend
to develop. 1.5.The proposed guidance should
specify the practices for which the expertise of
a RPE is mandatory required.
71.6. The recognition system should contain
provisions related to the cases where the issuer
finds that the owner failed to observe his duties
and responsibilities

9RPO 1.7. The revised EU BSS or at least the
proposed guidance should require the nomination
of the RPO for each controlled area. The
reference to the RPOs designation could be
included in BSS Article 19 paragraph 1
Requirements for controlled areas. 1. 8. The
proposed guidance should specify the practices
for which the nomination of a RPO is mandatory
required. 1. 9. A harmonized system of
recognition for RPO implies a unitary
classification of practices 1.10. The required
qualification should be a combination of
theoretical and practical knowledge on radiation
protection. The minimum time period of work
experience depends on the risk level associated
to the practice, type of practice and education
level and should be addressed in the proposed
guidance.
102. Requirements for training and education of
the RWs (1)
- As long as
- The specific duties of the RWs depend on the
nature of the practice and have to be established
by local rules and procedures. - The RWs
- have to respect the local rules and
radioprotection procedures - are subordinated to the RPO
- have to report any abnormal situation/malfunction
which could affect the safety, any incident, and
- have to participate by their established roles in
emergency situations.
112. Requirements for training and education of
the RWs (2)
- It could be considered that appropriate
requirements for training and education of RWs
should be - 2.1. High school degree education (corresponding
to 10-12 years of schooling) - and
- 2.2.The training provided by the licensee for
- the basic knowledge and understanding of
radiation properties, interaction, detection and
biological effects, - good knowledge of the local rules and the
operational radiation protection methods, - work instructions and the safety features of the
devices, - on the job training under the supervision of a
radioprotection officer or radiation protection
expert.
Recognition The recognition of the RWs consists
in a work permit issued by the licensee based on
an examination.
123. Romanian views on the best approach to reach
optimal harmonization of the ET requirements for
the RPEs, RPOs and RWs
In order to achieve the best approach to reach
optimal harmonization some actions should be
taken into consideration by the Member States
- To come into line to the proposed definitions,
competencies, responsibilities and EU guidance - To nominate the authorities empowered to
recognize the RPEs and RPOs - To have a unitary definition of specialities
(practices), for which is necessary specific
training module - To adopt the same structure and duration for the
training programme - To develop agreed criteria and mechanism for
recognition and for mantaining the recognition.

144.1. Possible revision of the regulations
- According to the Romanian Law no. 111/1996 on the
safe deployment, regulation, authorization and
control of nuclear activities, CNCAN is empowered
to issue regulations and it is responsible for
reviewing the regulations whenever it is
necessary for these to be consistent with
international standards. - Romanian definitions for RPE and RPO are very
similar with the EU proposed definitions.
Moreover, the responsibilities for RPE and RPO
are defined in the Romanian legislation in force. - As a consequence, it is appreciated that the
proposed guide and definitions for RPE and RPO
will not have major effects on the current
Romanian legislation, ET and recognition system
in place.
