Revised Developer Construct Agreement

• Concerns have been raised regarding the liability
  for defective construction being placed on the
  Consultant
• Consultants cannot obtain liability insurance for
  works completed by others (contractors)
• This change has subsequent impacts on the rest of
  the Agreement, such as section 3
• Section 5 of the Agreement has also been deleted

Revised Developer Construct Agreement

• Minor changes made
• Section 9.1 (10.1 in old agreement)
• Section 16 is a re-written version of the old
  Section 31 and clarifies the extent of a
  Consultants liability should they leave a project
• Section 22 clarifies when the Corporation assumes
  ownership of the assets
• Section 30 discusses when the Corporation may
  contribute to the cost of the works
• Sections 37-40 provide guidelines for Dispute
  Resolution
• Remaining changes are ancillary in nature and
  have little or no impact on the spirit of the
  Agreement
