The import process.
  • Once a product has been identified as a candidate
    for Latvian export, the product needs to be
    prepared much of the import process actually
    begins here in Latvia.

Preliminaries.
  • Check duty rate and quota. (Note Sales tax if
    applicable - in the United States is collected
    upon retail sale.)
  • Products are classified by Harmonized Code which
    is supplied on the Internet by the International
    Trade commission. There you can find duty rates.
    Quotas for your product (if any) are available
    from the US Customs.

  • If you are satisfied with the duty rate, then the
    food facility needs to be registered

Food facility registration with the Food and Drug
Administration (FDA).
  • Everyone who comes into contact with product
    needs to be registered
  • Manufacturer / processor / packer / warehouse
  • Exporter (if different from manufacturer).
  • Importer
  • US distributor / handler (most likely will
    already be registered).

  • Foods need to be properly labeled for import and

Transportation
  • Samples usually by air using and integrator
    such as UPS, FedEx, DHL and others.
  • Air faster, necessary for time-sensitive items
    - freshness. Delivery 1-5 days for most US
    destinations.
  • Ocean larger shipments, usually more
    economical. Delivery 4 weeks for east coast
    destinations, 5-6 weeks for midwest and west
    coast destinations.
  • (Dry and frozen product transportation
    available.)

Invoice - good preparation avoids problems
  • Make sure to identify buyer and seller
    completely.
  • Prepare invoice to show units as per import
    directory.
  • If kg are used, prepare the invoice to show kg,
    if liters are used, invoice should show liters,
    etc.
  • Values in USD are strongly advised as well.
  • Check product classification and advise
    Harmonized Tariff code.

Identify importer
  • Who will be the importer of record making entry?
    Usually the United States company will be the
    importer.
  • Importer companies are required to have a US
    Customs bond to protect against non-payment of
    duty. Can buy yearly bond or single entry.

Choose US Customs broker
  • Many choices, Latvian transportaion company /
    freight forwarder may have relationship or can
    refer to someone. Importer may already use one.
    Entry made based on transportation documents
    (bill of lading or air waybill), commercial
    invoice and other documents.

Packaging
  • Product packaging for transport very important!
  • Good packaging successful product arrival at
    destination.
  • Insurance will not pay claim if product is
    packaged poorly.

Submit FDA Prior Notice
  • The Food and Drug Administration requires that
    advance notice of cargo arrival is required.
  • Importer or broker can also fill out.
  • Submit as soon as you have required information.

Shippers Letter of Instructionto the
transportation provider
  • Address, contact telephone where goods are to be
    picked up (or dropped off).
  • Delivery address, contact telephone.
  • Who will perform / be responsible for Customs
    clearance.
  • The shipping weight (gross weight) and volume
    (dimensions) for the product.
  • Shipping method (air, ocean).
  • Any temperature / handling requirements for the
    product.

Issues.
  • If one is a first time importer may be
    scrutinized and examined. US Customs walk through
    helps.
  • US Customs has a right to examine all imports.
  • Customs exams xray exam, back-in exam,
    intensive exam. Approx. 1000 / container. FDA
    and USDA may also examine.

Timing
  • Make entry as quickly as possible
  • Air cargo - Customs entry can be made when
    aircraft leaves foreign soil.
  • Ocean entry up to 5 days before arrival.
  • If entry is not made within 15 days, US Customs
    can seize merchandise.
  • Watch delivery limited storage time at air
    cargo warehouses or import docks. Storage charges
    .
