The 2006 EU Strategy on Soil Protection
  • Soil is practically a non-renewable natural
    resource
  • Soil performs crucial functions for human
    activities and ecosystems survival
  • Costs of soil degradation are very high and are
    mainly borne by society and not by the land users
  • Soils are increasingly degrading or irreversibly
    lost accros the EU
  • There is a need for a comprehensive approach

THE DECO PROJECT CONTEXT
  • Remediation of contaminated sites is a strategic
    issue in the whole Europe (because the polluted
    areas compromise the possibility of a good land
    planning)
  • No European dedicated legislation or guidelines
    governing the issue of soil, subsoil and
    groundwater contamination. Member State adopted
    national rules
  • For this reason there is a need of good practices
    exchange among environmental authorities in
    Europe (in order to solve practical problems
    connected to technical, financial, as well as
    organizational issues)

AIMS OF DECO PROJECT
  • Identify good practices for soil and groundwater
    sites decontamination and monitoring
  • Identify potocols for the remediation of
    ex-industrial areas
  • At local, regional and national level in IMPEL
    member countries
  • Compare the approaches and best practices in
    order to evaluate their application in different
    technical-operational and regulatory-procedural
    contexts

DECO SOME COMMON CRITICAL ISSUES
  • Determining who should pay and how to finance a
    decontamination action
  • The risk analysis procedure is widely used in
    Europe to determine the acceptable level of
    substances into a specific area, but it is quite
    a complex instrument
  • Legislation on reclamation is complex and the
    interactions with EU and national regulations on
    waste and water are not clearly defined.
  • Procedures are very long and complex not only in
    terms of long time and high costs, but also for
    uncertain forecast

Discussion on the first part of the Format (i)
General aspects and management, legislation.
(ii)Starting of the procedures and activation of
the first investigations. (iii) Risk management.
(iv) Funding each issue was analyzed and
processed in relation to the answers received by
the Member States participating to the Project
First meeting Paris 3rd and 4th of June 2013

Discussion on the second part of the Format (i)

STEP3
Report gathering all the information exchanged
among IMPEL Member States on the implementation
of different procedures aimed to the
decontamination of groundwater and soils in
polluted ex-industrial sites. If possible,
publication of good practices examples, with
highlighted management methodologies and possible
suggestions, for the EU institutions and for
IMPEL Member States.

  • Chapter 1 - Regulatory Framework
  • The rule of polluter pays" is not easy to apply
    because the polluter is not always detectable
    (especially for the historical contaminations)
    and the payer is not always clearly definable.
  • The principle is easier to apply in new
    contaminations. It is applied in all EU
    countries.
  • Interesting to see how this issue is addressed at
    European level different mechanisms and tools to
    apply the polluter pays principle.
  • Need for connecting /integrating Contaminated
    site remediation legislation and other EU
    directives (Industrial Emissions IED,
    Environmental Liability ELD, Waste framework)
    and land planning.
  • Criteria to identify Potentially Contaminated
    Site and Contaminated Site pollutant
    concentration criteria (limit values) vs.
    different criteria (kind of pollutant, industrial
    activity geological criteria intended use of
    the site risk to human health and the
    environment ..)

    actions, but check the efficiency of measures
    and techniques adopted or planned (modeling vs.
    measuring short term solutions vs. long term
    source reduction/elimination vs.
    containment/monitoring .)
