Rule Making Initiatives

• Rail TIH Safety and Security
• On December 21, 2006, PHMSA published an NPRM
  proposing to revise the current requirements in
  the Hazardous Materials Regulations applicable to
  the safe and secure transportation of hazardous
  materials transported in commerce by rail. 
•  
• Also on December 21st , TSA published an NPRM
  proposing additional security requirements for
  rail transportation.
• Two public meetings are scheduled on the PHMSA
  NPRM
• 1. Feb 1st in Washington DC
• 2. Feb 8th in Dallas TX

Rule Making Initiatives

• Revisions to Security Plan Requirements.
• In response to two industry petitions for
  rulemaking, PHMSA published an ANPRM on September
  21, 2006.
• The ANPRM refines the list of hazardous materials
  for which security plans are currently required.
  
• The ANPRM creates a distinction between hazardous
  materials that present a significant security
  risk while in transportation and the vast
  majority of hazardous materials that pose minimal
  security risks in transportation.
• PHMSA hosted a public meeting November 30, 2006
  to obtain stakeholder input.

PHMSA MOUs Cooperative Agreements

• PHMSA TSA signed an annex to the DOT/DHS MOU.
  The Annex reflects the agencies shared
  commitment to a systems risk-based approach and
  to practical solutions to improve transportation
  security and safety.
• Developed a Cooperative Agreement with the
  National Association of State Fire Marshals.
• Entered into discussions with the International
  Association of Fire Chiefs (IAFC) to develop a
  cooperative agreement.
