WILDLIFE CONGRESS CHOSE TO PROTECT?
3WEEKS-McLEAN ACT 1913
Migratory Bird Act Passed due to ineffectiveness
of Lacey Act
4WEEKS-McLEAN ACT
The Act Boldly proclaimed that
All wild geese, wild swans, brant, wild ducks,
snipe, plover, woodcock, rail, wild pigeons, and
all other migratory game and insectivorous birds
which in their northern and southern migrations
pass through or do not remain permanently the
entire year within the borders of any State or
Territory, shall hereafter be deemed to be within
the custody and protection of the Government of
the United States, and shall not be destroyed or
taken contrary to regulations hereinafter
provided therefor.
5WEEKS-McLEAN ACT
Rested on weak constitutional grounds. Passed
as a rider to an appropriations bill.

Missouri filed restraint to prevent Ray Holland
(U.S. Game Warden) from enforcing the Migratory
Bird Treaty Act in the state.
14Missouri v. Holland 1920
U.S. contended that the treaty and implementing
legislation took precedence over conflicting
state laws. Supremacy Clause
15Missouri v. Holland 1920
But for the treaty and the statute there soon
might be no birds for any powers to deal with.
We see nothing in the constitution that compels
the government to sit by.. It is not sufficient
to rely upon the states. The reliance is vain.
16Missouri v. Holland 1920
Established beyond question the supremacy of the
federal treaty making power as a source of
authority for federal wildlife regulation.
