We are a consortium of tribes that have joined
together to address the transportation needs of
tribes within Alaska. The Commission of the SE
TDOT is made up of representatives from the
members tribal governments.

- Member tribes direct the activities to be

36 Membership Responsibilities
- designate a member to serve as Commissioner of SE
TDOT - designate a member to serve as Alternate
Commissioner of SE TDOT - authorize the Tribes SE TDOT Commissioner and SE
TDOT Alternate Commissioner to fully participate
in the SE TDOT Commission, including, but not
limited to, developing written policies,
operational procedures and transportation
priorities for SE TDOT - prioritize its IRR projects listed in the Control
Schedule and the TIP and notify the SE TDOT
Commission and Director of those priorities - work cooperatively with SE TDOT Director to
determine for each project the proper
distribution of responsibilities between the
Tribe, SE TDOT, and any third parties - work cooperatively with the SE TDOT Director to
establish a panel for the selection of
contractors and to advise the SE TDOT Director of
any Tribal Employment and Contracting preference
requirements that apply to IRR projects
37Membership Withdrawal
- retain the right to withdraw for any reason from
the CCTHITA Transportation Consortium and SE TDOT
by notifying the Consortium, the BIA, and the
Office of Self-Governance as required by 25
C.F.R. 1000.32, and to have its funds
thereafter administered pursuant to 25 C.F.R.
1000.33-.35 1000.253 - The tribe that withdraws may enter into its
own agreement with the Bureau of Indian Affairs
or the Federal Highway Administration
38May contract specific projects separately with
the BIA.
- retain the right to contract or compact
separately under the Act and Title 23 of the
United States Code, as amended, to perform
specific projects identified in the TIP or for
other special IRR funding allocations, without
affecting the Tribes right to participate in SE
TDOT or the CCTHITA Transportation Consortium for
other purposes.
39The SE TDOT is not available for pass-through as
other CCTHITA programs are.
- CCTHITAs agreement with the Asst. Secretary
Indian Affairs, is very severe in its
requirements. One of our primary
responsibilities is compliance, to assure that
all work performed is eligible and meets the
requirements under the Statutes and Regulations.
The IRR Program is funded out of the Highway
Trust Fund, not Interior Appropriations.
40The Future of the SE TDOT
- The Commission will serve as an advisory body to
the CCTHITA Transportation Consortium. In so
doing, it will set policy for SE TDOT, including
establishing written policies, operating
procedures, and transportation priorities for the
CCTHITA Transportation Consortium. The parties
agree that SE TDOT may at some future time
undertake the Self-Governance planning process
necessary to become a Tribal consortium under 25
U.S.C. 458bb(b)(2) 458bb(d) and 25 C.F.R.
1000.17 - .20, and may at that point enter into
its own Self-Governance Compact and AFA to assume
responsibility for administering the
participating Tribes IRR Program funds
