16Responding to MNC restructuring
- Restructuring can make companies more viable and
secure future quantities of jobs and the quality
of their working conditions - In short term restructuring enhances mergers,
transfers of production, collective redundancies
and plant closures - loss of employment security among employees
counters motivation and commitment - To assure the productivity, profitability and
employment in the company during and after the
restructuring, it is best to handle restructuring
in a social responsible way - The best way to do this is in social dialogue
between Management, workers representatives in
the EWC and Trade unions affiliated to EMCEF
17Challenges of MNC restructuring
- The risk of different plants and trade unions
being played off against each other - A reaction of trying to avoid any local pain is
more evident than one of sharing the pain - A coordinated response may have less painfull
results in total - coordination is easier with prepared scenarios
- Each restructuring is unique, nevertheless
lessons can be drawn and principles agreed to
prepare reactions
18- Develop early warning system
- Check rumours of a restructuring with EWC
colleagues - If information is confirmed, inform national
union officers, the EMF Secretariat, the EMCEF
EWC coordinator and EWC members - Anticipation is a pre-condition for influencing
the decision-making process. Informing all
actors allows rapid reaction. - Vérifier toute rumeur de restructuration auprès

192. Full transparency of information
- Full transparency of information is imperative to
build a climate of trust and confidence, which is
the prerequisite for a joint and co-ordinated
response. - Any attempt from management to strike a deal with
one plant or in one country will be reported to
the colleagues concerned or to the co-ordination
group. - No negotiation will be concluded before having
informed and consulted with the colleagues
concerned or the co-ordination group. - Une transparence totale des informations est
essential pour établir un climat de confiance, ce
qui est indispensable pour pouvoir réagir de
manière commune et coordonnée. - Les collègues du groupe de coordination seront
informés de toute tentative de la direction de

information is essential to understand the
company strategy and propose alternative

214. Explore legal possibilities that workers are
heard
- EMCEF secretariat can request that EWC members
are heard in the EU Commission merger control
procedure. - Questions are best formulated in terms of abuse
of dominant position. Social consequences can be
raised but are not considered by DG Competition. - The secretariat can organise a preperation
meeting for such a consultation at DG
Competition. The secretariat covers expenses of
the meeting venue. Travel and accomodation costs
are covered by participative trade unions. In
principle all meetings will be conducted in one
language, most probably english. Otherwise,
interpretation costs will not be covered by EMCEF
- Le secretariat dEMCEF peut demander par écrit
que des membres du CEE sont entendus dans la
procédure de contrôle des fusions de la
Commission européenne. - Questions à la DG Concurrence sont de préference
formulé en termes dabus de position dominante.
Les conséquences sociales peuvent être mentionné
mais ne sont pas prise en consideration dans ce
cadre là . - Pour un tel consultation par DG Concurrence, une
réunion preparatoire peut être organisées sous
légide de EMCEF. En principe, la EMCEF couvrira
les frais dorganisation de ces réunions. Tous
les autres frais (hébergement, voyage, etc.)
seront couverts par les syndicats nationaux. En
principe, toutes les réunions se dérouleront dans
une seule langue, très probablement langlais.
Sinon, des coûts pour linterpretation ne sont
pas couvert par EMCEF.

225. European approach coordinator cooperation
with secretariat
- The EMCEF Coordinator takes care of the general
interests of all workers, all through the
process. - The EMCEF secretariat provides support together
with trade union officers active in the company,
tie together all the potential actors around the
same objective - This will be the driving force behind the
European strategy and the establishment of a
European, co-ordinated response. Eventually, it
will become a social dialogue group in the event
of framework negotiations at European level. - Le coordinateur de la EMCEF veillera aux intérêts
généraux des travailleurs tout au long du
processus. - Le secrétariat dEMCEF ensemble avec les
personnes de contact des affiliés, fournissent du
support, en rassemblant autour du même objectif
lensemble des acteurs potentiels - Ceci sera la force vive de la stratégie
européenne et de létablissement dune réponse
européenne coordonnée. Eventuellement, il se
transformera en groupe de dialogue social en cas
de négociations cadres au niveau européen.

- A platform of common demands has to signal to
management and to the outside world that workers
intent to stand up together and develop
co-ordinated actions. - a plausible and coherent alternative concept
combining an industrial plan with socially
acceptable measures needs to be developed. - External experts can help on this, just like the
coordinator. The workload will be shared between
all actors. - Une plateforme de revendications communes devra
signaler à la direction et au monde extérieur
lintention des travailleurs de se défendre
ensemble et délaborer ensemble des actions

257. Envisage negotiated solutions acceptable for
all
- The unions, together with the EWC, will seek to
negotiate a framework agreement with management
at European level covering both industrial and
social aspects, guaranteeing that restructuring
is managed in a socially responsible manner and
that the sustainability of the company and
employment are guaranteed in the long run. - All possibilities to mitigate the social
consequences will be explored (reduction of
working time, reallocation of work, early
retirement, retraining, reclassification, etc.). - Minimum standards for a social plan will be
defined Europe-wide. No negotiation at national
level or within one plant will be concluded
before having informed and consulted with the
colleagues concerned at European level. - Les syndicats, avec laide du CEE, chercheront Ã
négocier un accord-cadre avec la direction au
niveau européen, couvrant à la fois les aspects
industriels et les aspects sociaux, garantissant
que la restructuration est effectuée de manière
socialement responsable et que la pérennité de
lentreprise et de lemploi est garantie sur le
long terme. - Tout ce qui permet datténuer les conséquence
sociales sera exploré (réduction du temps de
travail, réaffectation, retraite anticipée,
recyclage, reclassement, etc.). Tout plan social
devra respecter des normes minimales qui seront
définies au niveau européen. - Aucune négociation au niveau national ou au
niveau de lusine ne sera clôturée tant que les
collègues concernés au niveau européen nauront
pas été informés et consultés.
7. Envisager des solutions négociées acceptables
pour tous
268. Develop a communication strategy
- Exercising influence is the key to the success of
your strategy. - First reactions and decisions should be
immediately relayed inside and outside. - In order to ensure that the campaign is
worker-based, the unions, EWC members and
workers must be fully informed. - Communicating to the outside world is also
essential. The press, politicians, MEPs or anyone
with influence can be rallied to your cause. - Exercer dinfluence est crucial pour la réussite
de notre stratégie. - Les premières réactions et décisions doivent
immédiatement être relayées interne et externe. - Afin de garantir que la lutte est bien celle des
travailleurs, les syndicats, les affiliés et les
travailleurs doivent être pleinement informés. - Il est également essentiel de communiquer avec le
monde extérieur. La presse , les personnes
politiques, les députés européens ou toute
personne influente peuvent se rallier à notre
cause.

- Any strategy agreed, any decision taken, at
European level should be made binding for all the
actors concerned and implemented at national
level. -

- Any attempt needs to be made to help the
secretariat to coordinate to get a succesfull
outcome for workers concerned - EMCEF coordinator is driving force in this

trade union involved and the EWC, - Trade union coordination or preperation meetings
are organised with involvement of the
secretariat. If it is not the company, than the
secretariat covers expenses of the meeting venue.
