ME Requests What Was
  • Previous rules and guidance regarding requests
    for immediate status on the basis of military
    exigency (ME Requests) included
  • ME Requests had to be submitted in writing
  • The ME Request had to be signed by an O-6/GS-15
    or higher
  • ME Requests were expected to be the rare
    exception, not the rule
  • DOCPER tracked the number of ME Requests per
    contract and would ask organizations to cease and
    desist if they submitted too many

  • Current rules and guidance regarding requests for

  • ME Requests do not need to be submitted in

  • The ME Request does not have to be signed by
    anyone
  • ME Requests are expected to be common
  • DOCPER does not track the number of ME Requests
    per contract and would not ask organizations to
    cease and desist if they submitted too many

ME Requests What has always been
  • Despite the significant changes made regarding ME
    Requests, some things remain as they always have
  • An ME Request cannot be approved for Troop Care
    or Troop Care IT providers
  • An ME Request cannot be approved for an
    Analytical Support applicant until after the
    contract has received enterprise approval (Phase
    I complete)
  • An ME Request cannot be approved if there is any
    doubt regarding the approvability of the
    applicant

DOCPER Staffing Changes
  • In February of 2007, DOCPER had a staff of 12
  • Dorothea Christeson and Elke Santiago as DOCPER
    Team 1, Sigrid Jakoby and Nuala Richter as DOCPER
    Team 2, Anthony Estrada and Tatjana
    Petranovic-Hines as DOCPER Team 3, William Kruft
    and Brooke Bollenbach as DOCPER Team 4, Harry
    Jenkins and Renee Benjamin-Meier as DOCPER Team
    Italy, plus Russ Tillett as Senior Analyst and
    Armand Lepage as chief
  • Today DOCPER has a staff of 10
  • Dorothea Christeson and Elke Santiago as DOCPER
    Team 1 (including some Italy), Sigrid Jakoby and
    Nuala Richter as DOCPER Team 2, Anthony Estrada
    and Tatjana Petranovic-Hines as DOCPER Team 3,

Article X
  • During the last 2 years there have been 2 Article
    X cases presented before the highest German tax
    court. In both cases the findings were
    considered favorable to the US Forces.
  • In both cases there was clear direction given
    that any single OR factor was insufficient for
    taxation under Article X
  • In both cases it was made clear that
    demonstrable, documentable intent to return to
    the States was sufficient to preclude taxation
    under Article X
  • The number of Article X approvals has been
    decreasing for some time now and it is expected
    that the decrease will continue

Major Certifications
  • In the past, DOCPER has indicated that in
    position descriptions a major certification is
    considered the equivalent of an associates
    degree. We have never provided more than a
    couple of examples of certifications that would
    be considered major, allowing decisions to be
    made primarily on a case by case basis. In
    determining if a particular certification should
    be considered major, DOCPER considered three
    factors
  • The certification must be difficult to obtain
  • The certification must be widely accepted
  • The certification must be independently
    administered

  • The following certifications have been reviewed
    by DOCPER and are considered to be Major
    Certifications for status accreditation purposes
  • CCDP Cisco Certified Design Professional
  • CCIE Cisco Certified Internetwork Expert
  • CCISP Certified Information Systems Security
    Professional
  • CCNP Cisco Certified Network Professional
  • MCSE Microsoft Certified Systems Engineer
  • MCDBA Microsoft Certified Database
    Administrator
  • MCAD Microsoft Certified Application Developer
  • MCSD Microsoft Certified Solution Developer

2nd Tier Subcontractors
  • After a review of the Exchange of Notes
    implementing Article 73 SA, DOCPER has concluded
    that there is no prohibition against 2nd tier
    subcontractors receiving status under Article 73
  • 2nd tier subcontractors must be identified as
    subcontractors under the prime contract during
    the contract notification process or as part of a
    revised contract notification
  • Applications must indicate the company that the
    applicant is employed by
