New motor vehicle

A dealer-owned vehicle
A demonstrator vehicle
Other vehicle sold with a manufacturers new car

5Vehicles covered by the CA Lemon Law
- The vehicle must
- Be used mainly for personal, family or household
purposes - Have a gross vehicle weight no more than 10,000
pounds - Be used mainly for business purposes by any
person or business to which at least 1 but not
more than 5 motor vehicles are registered in
California

6Vehicles covered by the CA Lemon Law
- The motor vehicle must have been
- Purchased or leased in California
- Purchased or leased by a full-time active duty
member of the Armed Forces who was registered or
residing in California at the time of purchase or
lease or at the time the claim is filed
7Problems covered by the CA Lemon Law
- The lemon law covers vehicles with malfunctions
that - Are covered by the manufacturers written new
vehicle warranty - Substantially impair the value, use, or safety of
the vehicle to the consumer
8Problems NOT covered by the CA Lemon Law
- The California lemon law does not cover vehicle
problems that have arisen due to owner negligence
and abuse.
9Reasonable number of repair attempts
If, within 18 months from delivery or 18,000
miles on the vehicle odometer
- The same problem resulted in a condition that
could lead to a fatality and if the vehicle has
been subject to repairs at least twice by the
manufacturer and the owner has at least once
directly notified the manufacturer about the need
for repair.
10Reasonable number of repair attempts
If, within 18 months from delivery or 18,000
miles on the vehicle odometer
- The same problem has been subject to repair four
or more times by the manufacturer and the
consumer has at least once directly notified the
manufacturer that the vehicle needs repair
11Reasonable number of repair attempts
If, within 18 months from delivery or 18,000
miles on the vehicle odometer
- The vehicle has been out of service for over 30
calendar days (cumulatively) due to repair of one
or more nonconformities by the manufacturer.
