3National Rural Employment Guarantee Act
- NREGA was passed in September 2005
- became operational in February 2006
- Â
- Objective is to enhance livelihood
- security of rural people to rejuvenate
- the natural resources of area to
- stimulate economy

4- Hence the choice of work should address causes
- of chronic poverty like drought, deforestation
- and soil erosion
- Â
- State governments were expected to formulate
- NREG Schemes within six months and most of
- them have come out with State name rural
- employment guarantee scheme and made it
- operational since February 06.
- States should have annual perspective plan,
- however for the time being PP of SGRY or
- NFFWP may be considered
5Eligibility
- Open to all rural households excepting J K
- 100 days of guaranteed employment per
- household can be shared among adults who
- registered and applied for work

11Fund Release
- Centre and State to release funds into the
accounts of the authority at the district level - Funds will be released well in advance to the
implementing agencies - DPC will be a joint holder of the account
- Funds to be placed by DPC with PO according to a
sanctioned plan - Financial sanctions must be made known to the
panchayats
12Perspective Plans (PP)
- A district PP for at least five years to be
prepared by district - To begin with, PP under NFFWP to be revisited
- NFFWP draft plan to be discussed and approved
with modifications, if need be, by GS, GP, IP and
DP - Priority to be determined by GP
13Annual Plan
- To flow from PP
- Size of the plan and priorities to be decided
annually keeping in view the demand for
employment - GP to convene a meeting of GS in April/May every
year to estimate demand for labour and to propose
the number and priority of works for the next

14- GP to forward the proposals on the
recommendations of GS by June 30 - GS can recommend additional works
- GP to prepare a development plan and forward to
PO - Development plan should indicate existing demand
for work, demand for the previous year, works
on-going, works proposed for the next year,

15- GP also to identify the 50 per cent of works for
its area - PO to scrutinize the development plan for its
technical feasibility and satisfy himself - PO to consolidate all GP plans and submit them to

20- PO to get thumb impression of the applicant

- Gram Sabha also to be convened for mobilising
applications, registration and verification - Process of verification shall not take more than

21- Every registered household to be given a
registration number (as per the coding system to
be prescribed) - Copies of registration with one set of
photographs to be sent to the PO (for reporting
to intermediate and district panchayats) - If registration is false, name will be struck off
22- Job Card
- Â
- Household to be issued a job card by GP
- Job card to be valid for five years (provision
for additions/ deletions) - GP to undertake an exercise to update on annual
basis - GP to send the updated list to PO every year by
October for incorporation in labour budget the
DPC would prepare in December - Contd.
23- Performa of the job card to be uniform,
standardised in the shape of a pass book - State Governments may consider issuing electronic
job cards - Card holder may apply for duplicate job card, if
the original card is lost/damaged - Non-issuance of job card can be brought to the
notice of PO or DPC or designated grievance
redressel authority to be disposed of in 15
days
24- Demand for Work
- Adult member of a registered household may apply
for work on a plain paper giving registration
number of job card, date and number of days for
which employment is sought - A single application will do for different
periods during the year - A number of applicants may give a joint
application - Application received by PO to be forwarded to GP
25- Time Bound Employment
- GP to provide wage employment in 15 days (either
in ongoing works or a new work) - The applicant to be intimated by GP by means of a
letter and by a public notice displayed at
district, intermediate and gram panchayat levels - Applicants seeking works after exhausting 100
days can be given work if work is available after
accommodating those who have yet to complete 100
days entitlement - Contd.
26- Work to be offered on first-come-first-serve
basis priority for older in age and women in
providing work near their residence - Priority for women in such a way that at least
one-third shall be women - GPs to inform PO about employment allotment
- PO to make allotment if GP fails to allot
employment in 15 days
27MONITORING AND EVALUATION

28- Role of Gram Panchayat

implementing agencies and the muster rolls
maintained by them at work sites and the payments

unemployment allowance paid, social audit, flow
of funds, timely and correct payment of wages,
progress and quality of works
29- Role of District Panchayat and DPC
- Â To monitor all aspects of implementation
including registration, employment, social audit,
funds flow, progress, quality of works, timely
and correct payment of wages and unemployment
allowance. - Role of State Government
- Â To monitor the performance of all districts on
the quality and pace of implementation as laid
down in the national monitoring system and the
guidelines of state employment guarantee council - To send consolidated reports and returns to GOI
30- Role of the Ministry
- Â
- To monitor on the basis of the monitoring system
evolved by central employment guarantee council - To also monitor through district level and
national level monitors - A national on-line monitoring system to be
evolved for key performance indicators .
31- Evaluation
- Periodic evaluation studies to be taken up by
national and state employment guarantee councils - Studies to be entrusted to reputed institutions
and organisations - Centre and state may initiate these studies
- Copies to be furnished to central government
- Remedial action to be taken by the States/UTs on
the basis of observations - District panchayat and DRDA may also conduct
studies from time to time and report the outcome
to state and central govt.
32Works Permissible under the Act
- Water conservation and water harvesting
- Drought proofing (including afforestation and
tree plantation) - Irrigation canals including micro and minor
irrigation works - Provision of irrigation facility to land owned by
households belonging to the scheduled castes and
scheduled tribes or to land beneficiaries of land
reforms or that of the beneficiaries under the
Indira Awas Yojana of the Government of India - Contd..
33- Renovation of traditional water bodies including
desilting of tanks - Land development
- Flood control and protection works including
drainage in water logged areas - Rural connectivity to provide all-weather access
- Any other work which may be notified by the
Central Government in consultation with the State
Government - 50 per cent of the works in terms of cost to GP
- Remaining works for other Panchayats, line
departments, public sector undertakings of
Central and State Governments, Cooperative
Societies, reputed NGOs, Self Help Groups etc. - Selection to be based on technical expertise and
resources capacities to handle work within
timeframe
34- Facilities at the work site
- Medical aid, shade, drinking water, creche
specially if there are more than five children
below six years - A person engaged to tend to children to be deemed
as a worker - Payment of wages
- Wages as per the minimum wage rate fixed by State
Government/competent authority unless the wages
have been notified by Central Government under 6
(1) of the act Contd
35- Equal wages for men and women
- To be made on weekly basis but not later than a
fortnight - A part of the wage can be given in cash to meet
the daily needs - If the minimum wage fixed is linked to task
performed, workers are to be paid as per this - To ensure that workers get minimum wage if they
work seven hours - State Governments and PO to publicise wage rates
in simple language and also to be displayed at
the work site - PO, DPC and State Government to monitor wage
rates and revise them if necessary - District-wise average wage paid to be brought to
the notice of state council every year
36- Unemployment Allowance
- Â
- Unemployment allowance (UA) is to be paid if
employment is not shown within 15 days of receipt
of application - Unemployment allowance at such a rate as may be
specified by State Government by notification in
consultation with State Council - Provided that no such rate is less than
one-fourth of the wage rate for the first 30 days
and one-half of the wage rate for the remaining
period of the financial year - Contd.
37- Liability ceases
- i)Â When GP or PO directs the applicant or
- any other member to report for wor
- ii) When period for which employment is sought
comes to an end and no member turned up for
employment - iii) When the household has got 100 days of
employment - iv)Â When applicants wages UA is equal to the

38- UA to be sanctioned and disbursed by PO or such
local authority as the state government may
decide - UA to be given not later than 15 days from the
date on which it became due - State government may prescribe procedure for
payment of UA to be reported in the annual report
(to be submitted by DPC) - Disentitlement

provided - When applicant does not report for work within 15

39- ROLES AND RESPONSIBILTIES

- Advise the Central Government on all
- matters concerning the implementation
- of this Act.
- Review the Monitoring and Redressal
- Mechanism from time to time and
- recommend improvements required.

- of information about the schemes made
- under this Act.

- before Parliament by the Central

41- The Central Council shall have the
- power to undertake evaluation of the
- various Schemes made under this Act
- and for that purpose collect or cause
- to be Collected Statistics pertaining to
- the Rural Economy and the implementation
- of the Schemes.
- The Chairperson and Members of the
- Central Employment Guarantee Council
- shall be described by the Central
- Government.
42- State Government
- Make Rules on matters pertaining to State
responsibilities under the Act. - Make and notify the Employment Guarantee Scheme.
- Communication.
- Set up the Employment Guarantee Council.
- Set up the Employment Guarantee Fund.
- Budget provision for and release of State share.
- Planning and Implementation of EGS.
- Training.
- Pay Unemployment Allowance if Employment not
given in 15 days despite adequate funds being
available. - Monitoring and Evaluation and Research.
43- State Employment Guarantee Council
- Advising the State Government on all matters
concerning the Scheme and its Implementation in
the State. - Determining the Preferred works.
- Reviewing the Monitoring and Redressal Mechanisms
from time to time and recommending improvements. - Promoting the widest possible dissemination of
information about this Act and the Schemes under

44- Monitoring the implementation of this Act and the
Schemes in the State and coordinating such
implementation with the Central Council. - Preparing the Annual Report to be laid before the
State legislature by the State Government. - Any other duty or Function as may be assigned to
it by the Central Council or the State
Government. - The State Council shall have the Power to
undertake an Evaluation of the Schemes Operating
in the State and for that purpose to collect or
get collected Statistics pertaining to the Rural
Economy and the implementation of the Schemes and
Programmes in the State. - Terms and Conditions of the Chairperson and
Members of the State Employment Guarantee Council
shall be described by the State Government.
45- District Level
- Role of Panchayati Raj Institutions.
- Â
- The Village, Intermediate and district Panchayats
shall be the Principal Authorities for Planning
and Implementation of the Scheme made under the
NREG Act. - The Panchayats at all levels can be the
Implementing Agencies under the Act. - At least 50 works in terms of cost will be
allotted to Gram Panchayats for Implementation. - Contd..
46- The Gram Panchayat shall be Responsible for
identification of the Project to be taken up in
its area under the Scheme as per the
Recommendations of the Gram/Ward Sabha and the
same shall be forwarded to Programme Officer for
scrutiny and preliminary approval. - The Gram Panchayat shall prepare a development
Plan and maintain shelf of possible works to be
taken up under the Scheme as and when demand for
work arises. - The Intermediate Panchayat shall approve block
level plan and forward the same to District
Panchayat for approval. - The District Panchayat shall finalise and approve
block-wise shelf of projects to be taken up for
Implementation under the scheme. - The Plan approved by District Panchayat will
assign implementation responsibilities to various
agencies like Panchayats, Line Departments, NGOs
etc.
47- District Programme Coordinator
- To assist the District Panchayat in discharging
its functions under this act and any Scheme made
there under. - To consolidate the plans prepared by the blocks
and project proposals received from other
Implementing agencies for inclusion in the shelf
of projects to be approved by the Panchayat at
District Level. - To accord necessary sanction and administrative
clearance, wherever necessary. - Contd.
48- To coordinate with the Programme Officers
functioning within his jurisdiction and the
implementing agencies to ensure that the
Applicants are provided employment as per their
entitlements under this Act. - To review, monitor and supervise the performance
of the Programme Officers. - To conduct periodic inspection of the works in
progress. - To redress the Grievances of the Applicants.
- To prepare in the month of December every year a
labour budget for the next financial year
containing the details of anticipated demand for
unskilled manual work in the district and the
plan for engagement of labourers in the works
covered under the scheme and submit it to the
district panchayat.
49- Programme Officer
- Responsible for matching the demand for
employment with the employment opportunities
arising from projects in the area under his
jurisdiction. - Overall supervision and coordination of
registration of applicants for employment and for
providing wage employment in accordance with the
provisions of the Act and the scheme notified by
the State. - Prepare a plan for the block under his
jurisdiction by consolidating the project
proposals prepared by the Gram Panchayats and the
proposals received from Intermediate Panchayats. - Contd.
50- Receive resources from District Programme
coordinator and the release them to the
implementing agency in accordance with these
guidelines and the scheme of the State
Government. - Maintain proper accounts of the resources
received, released and utilized. - Monitoring of projects taken up by the Gram
Panchayats and Other Implementing/Executing
Agencies within his jurisdiction. - Sanctioning and ensuring payment of unemployment
allowance to the eligible households. - Contd
51- Ensuring prompt and fair payment of wages to all
labourers employed under a programme of the
scheme within his jurisdiction. - Ensuring that regular social audits of all works
within the jurisdiction of the Gram Panchayat are
carried out by the Gram Sabha and that prompt
action is taken on the objections raised in the
Social Audit. - Dealing promptly with all complaints that may
arise in connection with the Implementation of
the Scheme within block. - Any other work as may be assigned to him by the
district programme coordinator or the State
Government. - The Programme Officers shall-function under the
Direction, Control and Superintendence of the
District Programme Coordinator.
