• Service sector accounts for 70 of GDP and
  employment in majority of Member States
• Some specific services involve risks to the
  consumer

EU Regulation

• GPSD only refers to services in respect of the
  directive applying to products in the context of
  providing a service
• Council Recommendation on fire safety in hotels
• Reports commissioned on Fairgrounds and amusement
  parks, dangerous sports and leisure activities,
  water recreation
• Report on the safety of services (2003)
  inconclusive as to action required more data
  needed
• Broadening Knowledge Base

National Regulation

• EU report on national services regulation
• Number of member states have general safety
  requirement comparable to GPSD often in their
  implementation of GPSD - B, FR, FIN, NOR, SWE
• Other member states include in general consumer
  protection law e.g. Spain or safety at work
  legislation e.g. UK.
• All member states have sector specific rules in
  one or more consumer sectors

How to address services issues in EMARS II

• Collect data on national market surveillance
  activities directed at services
• Include services in Knowledge Base
• Address use of products in services in specific
  joint actions
• Examine services within context of best practice
  handbook for carrying out joint actions from
  perspective of products sued during the course of
  the provision of a service and also from the
  perspective of the safety of a service not
  related to the safety of a product
• Identify European Standards for services
