Sunday, March 13, 2005
  • Chad Tindell received a telephone call from Tyler
    Harber. In his discussion, Harber complained to
    Tindell about a statement that Tindell had made
    only one time, in an email on the previous
    evening. Tindell suspected that Harber had
    access to either his computer or his email
    account

Monday, March 14, 2005
  • Tyler Harber accessed Chad Tindells personal
    email account, without permission, at
    bellsouth.net (tindellc_at_bellsouth.net) on Todd
    Cooks computer at the Knox County Probation
    Office. These emails were copied on the copying
    machine in the front secretarial area

  • Tyler Harber delivered numerous emails involving
    five individuals to the office of the Knox
    County Mayor on Monday, March 15, 2005.

  • Mike Ragsdale left copies of emails from Gay
    Drinnen to Chad Tindell dated Monday, March 14,
    2005 at 1234 a.m. and 1049 a.m. in Gary
    Drinnenss chair at his cubicle in the Mayors
    office.

  • Gary Drinnon found copies of his personal email
    communications with Tammy Miller, Chad Tindell,
    and Suzie Alcorn in his chair upon arriving to
    work.
  • Mike Arms stated that Mike Ragsdale left the
    emails so he would know.

  • Tyler Harber told Mike Arms that Tyler had
    retrieved and copied the emails left at the
    mayors office on Monday, March 14, 2005.

  • Mike Arms told Mike Ragsdale that Tyler Harber
    was the source of the email.
  • There was a discussion amongst Arms, Ragsdale,
    Dwight Van de Vate, and Allison Wagley that
    Harber needed to be asked to resign.

  • In response to the question- How did you end up

  • Ragsdale responded I dont know, I came back
    from lunch and they were there in his in-box on
    Monday, March 14, 2005.

  • Ragsdale mislead Sheriff Hutchison when Ragsdale
    suggested that someone in Chads group forwarded
    the emails.
  • Ragsdale again stated that he did not know, did
    not have the first clue as to who sent the emails.

  • Adam Groves interviewed by DJ, Keith Lyon and
    Bryant.
  • Groves originally consented to computer being
    analyzed, then revoked. Search Warrant issued.

  • Tyler Harber, while under surveillance, began
    driving in a reckless manner. He was stopped and
    issued a citation for reckless driving.
  • Mr. Harber responded I do not know what you are
    talking about when asked about cooperating in
    the email investigation.

  • Tyler Harber drove to the Andrew Johnson
    Building, obtained his Knox County computer, and
    hid that computer in the basement of the Andrew
    Johnson Building.

Thursday, March 17, 2005
  • At 900 a.m., Tyler Harber told Mike Arms that
    the Knox County computer assigned to Harber was
    missing.
  • At 930 a.m., Harber met with Mike Ragsdale, Mike
    Arms, Dwight Van de Vate in Mike Arms office.

  • Harber told Arms, Ragsdale, and Van de Vate that
    he had used Chad Tindells username and password
    to access Chad Tindells personal email.
  • Harber reiterated that he did not know the
    location of the Knox County computer assigned to
    him.
  • Mike Arms informed Todd Cook of the situation.

  • At approximately 400 p.m., Bryant asked Cook
    about obtaining Harbers computer for analysis.
    Cook stated that it was Ragsdales decision.
  • At approximately 800 p.m. Cook, by telephone
    told Bryant that the Knox Sheriffs Office could
    have Tyler Harbers computer.

  • Tyler Harber sent a memo to Todd Cook detailing
    the fact that the laptop and desktop computers
    were in Harbers office on March 16, 2005 at 745
    p.m. and were discovered missing on Thursday,
    March 17, 2005.

March 21, 2005
  • Harber directed Todd Cook, Dick Moran, and Jon
    Gustin to the pilfered Knox County computer
    located behind an air conditioning duct in the
    basement of the Andrew Johnson building.

  • Todd Cook left a voicemail for Dick Moran
    detailing his discovery of evidence that Tyler
    Harber had used Cooks computer and requesting
    someone from Knox County Information Technology
    to maybe look at my machine, see if hes put
    anything on it

    an unknown carrier to Jay Witt, an employee of

    software residing in, communicated by, or
    produced by a computer or computer network
    commits an offense punishable as provided in
    39-14-105.

  • 39-16-503 states that (a) It is unlawful for any

    or(2) Make, present, or use any record, document
    or thing with knowledge of its falsity and with

    investigation or official proceeding.

    computer with the intent to impair its
    availability as evidence.
  • Tyler Harber did not return the pin drive used by
    him during his employment at Knox County, and
    indeed impaired its availability as evidence.

  • 39-16-502 states that It is unlawful for any
    person to make a report or statement in response
    to a legitimate inquiry by a law enforcement
    officer concerning a material fact about an
    offense or incident within the officer's concern,
    knowing that such report or statement is false
    and with the intent to obstruct or hinder the
    officer from apprehending or locating another
    person suspected of committing an offense.

    had his computers, stated that that the KCSO
    could have Harbers computer for analysis.

  • Rebecca Smith Despite the belief that
    Rebecca Smith needed to be terminated for cause,
    Rebecca Smith was paid 4,000 upon the
    termination of her employment with the mayors
    office because, because, as explained by Arms, I
    mean it was one of thoseyour calling a state
    senator saying were terminating your daughter.
