"Alberta Wills and Estate Planning Question : Are there any special considerations that go into estate planning for gay and lesbian couples? Answer: In Alberta, from a legal point of view a gay or lesbian couple is the same as a heterosexual couple. A more relevant factor may be whether or not the couple has children. A childless couple will often want to appoint adult nieces and nephews, or even younger adult friends, as alternate executors for the wills, alternate attorneys for the powers of attorney, and alternate representatives for the personal directives. On the other hand, a couple with adult children will typically appoint one or more of the children as alternate representatives. Estate Planning Question : With a husband and wife, would you prepare one joint will or two wills? Answer: Some jurisdictions allow for joint wills. However, my practice is to prepare two wills, one for each spouse. I think joint wills have too many drawbacks. In particular, a husband and wife’s wishes are not always in line. For example, the husband may wish for one of his siblings to be his alternate executor, and the wife may wish for one of her siblings to be her alternate executor. In all likelihood, one spouse will predecease the other, rather than both dying at the same time. Since a joint will may be probated for the spouse who dies first, the second spouse would then likely have to do another will anyway. "Q: Is a will drafted in Alberta valid in other countries? Answer: In many countries, a will drafted in Alberta would likely be valid. Such countries are probably those that have a legal system similar to the one used in Alberta, which is derived from the English common law legal tradition. I recommend that clients who are planning on living in any country outside of Canada check with a lawyer in that country to determine whether their Alberta wills would be considered valid. "Calgary Legal Wills FAQ - What is a codicil? Question: What is a codicil? Answer: A codicil is a document that amends an existing will. Codicils are somewhat rare these days. Before the use of computers in law offices, the preparation of a will was a labour-intensive task. It would cost a lot in terms of time and money to do a new will simply to change the name of an executor or to change a minor gift within the will. Codicils were designed for these purposes. Today, a lawyer usually saves a draft of your will that can be easily modified at a later date. For this reason, codicils are rarely used today. Question : Is it easy to track down a will of a deceased relative if I don’t know where it is located? Answer No. This can be quite difficult. If you know the deceased person used a particular lawyer for some purpose in the past, you should try to contact that lawyer. If you have trouble finding that lawyer, you should contact the Law Society of Alberta to see if that lawyer is still practicing. If this turns out to be a dead end, you should contact banks that the deceased relative had dealings with to see if one of these has a safety deposit box belonging to the deceased. Though it’s not a good idea to store your will at home, many people do this. Places to check are desk drawers and filing cabinets, a safe (if the deceased had one), and even storage containers within a freezer. I have learned that some people use freezers to store important documents, however, I don’t personally recommend this storage technique.

Calgary Immigration Question: Can Canadian citizenship be revoked? Answer: Yes. Canada is moving towards an immigration system that is primarily concerned with satisfying the needs of the Canadian labour market. At the same time, the immigration system is moving away from admitting immigrants that may create a financial burden for Canadian taxpayers. Such “troublesome” immigrants include elderly family members of immigrants, such as parents and grandparents, people with medical conditions, people with criminal records, and refugee claimants. While I don’t agree with government policy in many instances, the current government’s trends seem to me to be crystal clear. Russ Weninger is a Calgary Immigration lawyer specializing in the areas of immigration, citizenship and refugee law. Call (403) 265-4496 for more information today.
While the majority of Canadian lenders do their best to protect the consumer, remaining within the confines of state and federal laws, and adhering to real estate law and ethics, an unscrupulous minority of lenders exist who make it their objective to target the uninformed. Knowing reputable lenders from predatory ones can help you avoid getting involved in a scam and potentially losing a lot of money.

If I make a mistake on a notarized document, can I white it out? No, in most cases you should not white out mistakes on a notarized document as this may invalidate the document itself. If you discover a mistake on the document, you should cross it out, and you and the notary should both place your initials beside the crossed out mistake.
