- The question of the SWIM Operator is key in term
of safety and also key in term of business model. - In the example of the GNSS framework, an EC
regulation Regulation (EC) No 638/2008 of the
European Parliament and of the Council, of 9 July
2008, on the further implementation of the
European satellite navigation programmes (EGNOS
and Galileo) declare that the EC shall be the
owner of all EGNOS system assets, shall finance
the procurement of evolution, shall fund its
operation and maintenance for the provision of an
EGNOS services by means of public service
contracts. - For SWIM services, one can envisaged that they
are sold to users on the basis of an annual
subscription subject to a payment of a fee in
respect of the users needs. It should also be
considered the possibility that this annual
subscription of SWIM services by the major actors
of Air Transport (airlines, airports, ANSP, etc.)

Governance - In the SWIM System any single actor (public or
private entity) can be a publisher or a user of
ATM information, operating independently of each
other. - There is no hierarchical relationship between the
SWIM actors. - How can we design a Governance system for SWIM?
Let us examine how others similar situations have
been regulated, if any.

both are formed by many actors that operate with
a certain degree of freedom in both cases the
actors can be publishers or users of information,
operating independently. - The Internet Society (ISOC) has developed the
main principle for an internet Governance
proposed in a code of conduct that has not been
approved yet. - A code of conduct is adopted for regulating
several fields where many actors operate
independently.

- The code of conduct shall enforce the technical
principles which ensure the stability and
security of the system and the traceability of
eventual responsibility, and shall be compulsory
for all actors and all parties. - there shall be a system of administrative
sanctions for infringement of the above
regulations. - If an infringement causes damage to third
parties and/or their properties a third party
liability regime shall be set up.

- SWIM already contains many technical principles
regarding data security, for example
authentication, authorisation, confidentiality,
non-repudiation, standardised language and
service interoperability, which should form the
code of conducts technical regulations. - All these technical features should be translated
into a set of compulsory (technical) regulations
for SWIM actors, for the correct functioning of
the System within a complete legal framework. - The regulations of the code of conduct can be
contained in a contract between a possible future
operator of the System and the users. But - What is the most suitable type of contract when
you have to define the relationship between a
single entity and many parties?

- ... we have come to the conclusion that one of
the instruments that should be used for a
complete Governance of SWIM is the contract of
adhesion. The contract shall set out the
different services offered by SWIM, their
features and their performance standards. - This contract is a standard framework agreement
set up by the SWIM service provider, which the
users must adhere to if they wish to purchase
SWIM services - How can one enter into such a contract?

- We assume that a commercial operator will
provide and offer SWIM services and will be one
party of the contract. - The other party is represented by a multitude of
SWIM users regardless of their role (manager,
publisher and contributor). - Services will be offered to users on the basis of
an annual subscription subject to a payment of a
fee on the basis of the users needs. - A contractual relationship should be mandatory.
This is because commercial flights can not be
provided without using ATC services.

- Regarding points 2 and 3 (liability system and
sanctions) - The technical principles ensure the stability and
security of the system and the traceability
system, which allows the identification of
responsible parties (liable party) that published
wrong or misleading or incomplete information. - The framework contract should comprise two
different provisions for wrong or misleading or
incomplete information, when it doesn't causes
damage and when it does.

- In the first case, if wrong or misleading or
incomplete information published in the system
has not caused problems or even incidents, but
was potentially a cause of incidents, a sanction
should be established. In this case the
(administrative) sanction acts as a deterrent. - The contract shall designate who is in charge of
such evaluation and of imposing sanctions. - Sanctions will be progressive and proportional in
respect of the gravity of the mistake up to the
notice and termination of the contract.

- In the second case when damage is caused by
wrong or incomplete information, a liability
system including a compensation system for damage
of properties and personal injury to the victims
should be created. - Normally, principles of private law quite common
to Member States for compensation of damage
comprise the loss of profit and accruing damage,
and these principles will be taken into due
consideration.

- Again, in the second case when damage is caused
also to third party not linked to liable party by
any contract, a Third Party Liability System must
be established, according to international
principles. - These principles, which normally includes
channelling, strict and limited liability and
compulsory insurance system, have already been
presented in the occasion of the previous Users
Forum (see presentation on SWIM website)
