Bill C-29
  • Section 78.6 of the Patent Act came into force on
    February 1st, 2006
  • It provides relief to patent holders and
    applicants who were adversely affected by the
    Dutch Industries decision
  • Essential that clients be aware of the 12-month
    window opportunity to make corrective payments if
    required

Diplomatic Conference on TLT
  • CIPO will attend the Diplomatic Conference in
    Singapore (March 13-31, 2006)
  • CIPO consulted stakeholders to ensure that
    Canadas interests are taken into account during
    the negotiations
  • CIPO will keep the profession informed of the
    outcome of this Diplomatic Conference for the
    adoption of the revised Trademark Law Treaty
  • IPIC can seek observer status at WIPO

  • Revised Practice Notice for Procedures before the
    Trade-marks Opposition Board in October 2005.
  • Received several submissions from the
    profession. 
  • Proposed amendments provide guidelines for
    parties seeking an interlocutory ruling on the
    sufficiency of pleadings (statement of
    opposition).
