Damage Caused by Golf Balls
Escaping Balls The game of golf involves certain
risks. Occasionally a golf ball escapes its
intended path and inadvertently strikes and
damages an object. If you or your property is
damaged by an errant golf ball, you may be
eligible to file a claim under either the
Military Claims Act or the North Atlantic Treaty
Organization Status of Forces Agreement. The
Military Claims Act (MCA) This statute applies
to United States citizens and their dependents
residing in Germany for the purpose of supporting
the United States Armed Forces in Europe. If you
are a servicemember, a Department of the Army
Civilian employee, or dependent you can file a
claim for personal injury or property damage at
any military installation. The North Atlantic
Treaty Organization Status of Forces Agreement
(NATO SOFA)
If you are a German citizen or a foreign national
who is a resident of Germany you can file a
claim under the NATO SOFA. No standard written
format is required. However, you must provide a
written statement indicating how the damage
occurred and the claimed amount in United States
dollars. You must provide notice within 90 days
of the incident. Any bills, statements, or
estimates of repair may be submitted at a later
date if they are not available within 90 days of
the incident that gave rise to the claim.
