1951 Convention - refugee definition
  • Owing to well-founded fear of being persecuted
    for reasons of race, religion, nationality,
    membership of a particular social group or
    political opinion, is outside the country of his
    nationality and is unable or, owing to such fear,
    is unwilling to avail himself of the protection
    of that country or who, not having a nationality
    and being outside the country of his former
    habitual residence as a result of such events, is
    unable or, owing to such fear, is unwilling to
    return to it.

    and family life, his home and his correspondence.
  • There shall be no interference by a public
    authority with the exercise of this right except
    such as is in accordance with the law and is
    necessary in a democratic society in the
    interests of national security, public safety or

    prevention of disorder or crime, for the
    protection of health or morals, or for the
    protection of the rights and freedoms of others

    medical report to be written by myself is
    unrelated to his or her ability to pay, whether
    via legal aid or otherwise.
  • I have not entered into any arrangement where the
    amount or payment of fees to myself is in anyway
    dependent on the outcome of the case.
  • I understand that my duty in providing written
    reports is to help the court and that this duty
    overrides my obligation to the party who has
    commissioned the report. I confirm that I have
    complied with that duty.
  • I believe that the facts I have stated in this
    report are true to the best of my knowledge and
    that the opinions that I have expressed are
    correct.
  • I have endeavoured to include in this report
    those matters of which I have knowledge or of
    which I have been made aware, that might
    adversely affect the validity of my opinion.
  • I have not, without forming an independent view,
    included or excluded anything that has been
    suggested to me by others, in particular the
    party instructing me.
  • I will notify those instructing me immediately
    and confirm in writing if for any reason my
    existing report requires any correction or
    qualification.
  • I understand that I am likely to be the subject
    of adverse public criticism by the court if it is
    concluded that I have not taken reasonable care
    in trying to meet the standards set out above.
