16DCA ORC Report
- Three Objections
- Impacts to natural resources associated with
Paynes Prairie -
- Given the character of the amendment site and
the density of the proposed future land use
category, the County has not demonstrated the
amendment will not negatively impact onsite
natural resources as well as the wetlands and
natural resources and wildlife associated with
Paynes Prairie. Furthermore, the County has not
included the resources management plan required
by COSE Policy 3.4.1. Therefore, the amendment is
not consistent with the natural resource
protection requirements of Chapter 163, F.S.,
Rule 9J-5, F.A.C. and with Alachua County
Comprehensive Plan policies to protect natural
resources including COSE Policies 3.4.1, 3.6.3,
and 3.6.6.

- Impacts to local roads including those which
provide access to the project site - The proposed amendment is internally
inconsistent with the Alachua County
Comprehensive Plan Future Land Use Element Policy
1.3.8.2 which requires development in the Medium
Density Residential land use category have access
to an arterial or collector roadway. The location
of the amendment site, within the Gainesville
Golf and County Club, does not have access to an
arterial or collector roadway.

- The proposed plan amendment is not consistent
with and does not further the following goals and
policies of the State Comprehensive Plan (Section
187.201, F.S.) - (7) Water Resources, Goal (a) and Policies (b) 8

Goal (a) and Policies (b)1, 7, 10 (15) Land
Use, Goal (a) and Policies (b) 2 and 6 (21) The

19Applicant Response
- On June 16, 2008, the applicants agent submitted
a draft Development Agreement for review by
staff. However, DCA has indicated that such an
instrument is not appropriate to address the
concerns raised in the ORC report. Rather, DCA
finds that revisions should occur to the CPA
itself. County staff support this finding
20Staff Finding
- Staff finds that the proposed Development
Agreement does not adequately address the
objections raised in the ORC report or the
concerns of County staff as stated in the first
staff report. Issues related to environmental
impacts have been only partially addressed while
issues related to traffic and concurrency have
been ignored
21Staff Recommendation
- Based on the findings of the ORC report as well
as previous findings by staff in its first staff
report, staff recommends that CPA-02-08 not be
adopted. County Staff has cited inconsistencies
with the County Comprehensive Plan, most notably
with numerous policies found in the Conservation
and Open Space Element. Also cited are policies
within the Future Land Use Element relating to
vehicular access to the proposed site (FLUE
Policies 1.3.8.2 and 1.5.2). As an alternate
recommendation, the BoCC could direct the
applicant to resubmit the request at an alternate
location during the next large scale
comprehensive plan cycle. The Growth Management
Department anticipates that applications for this
cycle will be accepted sometime in the fall of
2008.
