Textbook Laws
  • Textbooks must meet all requirements of the
    Kentucky Textbook Accessibility Act.
  • Additional applications, or other supplementary
    materials purchased with the textbook should also
    be accessible if used in the classroom.

Textbook Issues
  • Textbook publishers do not provide e-text
    versions of their books for purchase at the
    bookstore.
  • E-texts that are provided are sometimes not
    accessible, for instance locked PDFs that contain
    no text.
  • Supplementary applications or other materials
    provided are not accessible (on-line
    applications, videos, etc.)
  • Students must wait for books to be scanned by
    OSID.

Choose Applications Wisely!
  • Vendor must provide informational checklist of
    usability and accessibility for any product.
  • Vendor must sign off on a penalty for
    non-compliance and/or inaccurate reporting, and
    provide a time schedule for repair.

Web-based Info/Applications
  • Web interfaces must meet basic university
    requirements for accessibility and usability by
    persons with disabilities.

Videos, DVDs, Podcasts, Tutorials
  • Video and multimedia products must have captions
    or transcripts with visual description provided.
  • E-text must be provided for any additional
    workbooks, study sheets, tests, etc.
  • EKU provides quick transcription services for
    legacy audiovisual products when necessary for
    class use and no alternative format is available.

Why now?
  • Assistive Technology has improved. More
    individuals with disabilities are online, taking
    classes, and in the workforce
  • Freedom Initiative Act with DOJ visits
  • Kentucky laws are relatively recent (2000-2006)
  • Some current applications are inaccessible to
    students and employees, and we cannot provide
    accommodations easily

Kentucky Accessible Textbook Act
  • 164.477 Kentucky Postsecondary Textbook
    Accessibility Act
  • A publisher will provide textbooks in electronic
    format within 15 days of request (at no cost)
  • Electronic format will be XML, DAISY/NISO or
    another format mutually agreed upon
  • Documentation of student disability will be
    provided to the publisher
  • CPE can create a state repository

  • Effective, interactive control and use of
    technology can be achieved by alternative and non
    visual means.
  • The technology, networks, software, and data
    collection should be compatible with existing
    systems.
  • University communications should be accessible to
    all.

  • Information technology purchased prior to July
    14, 2000 shall be brought into compliance when
    the covered entity upgrades or replaces the
    existing equipment or software. Nothing in KRS
    61.980 to 61.988 shall be construed or
    interpreted to require the replacement or upgrade
    of existing equipment or software.

    verification from the vendor the product is
    accessible to employees and students with
    disabilities

Recommendations Software purchases
  • The following language (or similar) should be
    included in bids, contracts, descriptions of
    work, amendments, renewals and related
    boilerplate and template documents
  • As required by Kentucky KRS 61.980-61.988, all
    information technology, including electronic
    information, software, systems, and equipment,
    developed or provided under this contract must
    comply with the applicable requirements of the
    Kentucky Accessible Information Technology
    Statute.

Recommendations Textbook purchases
  • The following language (or similar) should be
    included in purchase orders for textbooks
  • As required by 164.477 Kentucky Postsecondary
    Textbook Accessibility Act, all textbooks must be
    available in electronic format, fully accessible
    for use by students and faculty with
    disabilities. Any supplemental electronic
    materials or applications must also be
    accessible.

    customize the user interface configurations?
  • Is your online documentation accessible (tagged
    PDF, well-structured HTML, captioned video or
    animation, etc.)?
  • What other processes do you use to verify
    usability for people with disabilities?
  • What is your timeline for repairing accessibility
    issues?
