  • EXERCISE 1
  • You currently have a foreign Research Assistant
    working in the lab. The Canadian Immigration
    authorities didnt require that he have a work
    permit to do this work. An additional foreign
    national was just invited to come to the lab to
    do exactly the same kind of work but Immigration
    wont let her come to Canada without the
    Department first advertising the position and
    obtaining a Service Canada (HRSDC) confirmation.
    Theyve said she must also have a work permit.
  • What might have caused Immigration to treat the
    two foreign nationals differently?

  • A foreign Postdoctoral Fellow was invited to
    the U of A for a one-year period. He had no
    trouble obtaining a work permit. The first
    morning that he comes to the lab, you ask to see
    his work permit. Everything appears to be in
    order except that the occupation does not list
    him as a Postdoctoral Fellow.
  • Can the foreign national still register with the
    Postdoc Office and be paid?
  • If he had a study permit instead of a work
    permit, could he still register with the Postdoc
    Office and be paid?

  • Your department has recently hired a Canadian
    Research Associate. Your department would also
    like to hire her husband - but he is not a
    Canadian citizen. The University has waived the
    advertising requirements for the position.
  • What action does your department need to take to

    take?

    letter indicating that Dr. X will be her
    Supervisor at the University of Alberta. The
    Supervisor has also signed this appointment
    letter. At some point during the appointment,
    the Postdocs Supervisor has decided to leave the
    U of A to take a position at another institution.
  • Must this Postdocs appointment end?

  • A Korean citizen has been hired and although she
    will not be physically at the U of A until
    September, the hiring Department wants her to
    begin paying her now. This seems like the fair
    thing to do considering the fact that she will be
    spending her time making preparations for her
    research at the U of A.
  • Can the U of A begin paying her before she has a
    work permit?
  • What factors need to be taken into
    consideration?

  • Last year, a Chinese national came to the U of A
    to carry out research. For that visit, Canadian
    Immigration authorities didnt require that the
    University first obtain a confirmation from
    Service Canada. The foreign visitor planned to
    come back to the U of A to finish his research
    but this time, Immigration is insisting that the
    U of A obtain a labour market opinion before the
    he can apply for a work permit.
  • Its the same Researcher, doing the same work,
    for the same employer, at the same location. Why
    is Immigration now insisting that a different
    process take place before he can come back to
    Canada?

    to the U of A from UBC that was recently offered
    a fellowship at the University of Alberta. Her
    work permit hasnt expired and it lists her as
    Postdoctoral Fellow.

    A?
  • Can the U of A pay her?
  • Who should be consulted regarding arranging pay
    for her?

    employed at the University of Toronto. He has
    agreed to start work at the U of A next week.
    His current work permit hasnt expired and it
    lists that his occupation is a Research
    Associate.

    current work permit?
  • If not, is it alright for him to start working at
    the U of A once he applies for a new work permit?

  • A foreign national will begin work as a Field
    Assistant for the University of Alberta. His
    work permit lists his employer as the University
    of Alberta and the location of work is listed as
    Edmonton. His occupation is listed as a Field
    Assistant and the expiry date of the work permit
    is 2008.
  • Can he work in the field in northern BC and
    southern Saskatchewan?
  • If not, what needs to be done?
