- GRIEVANCE AND ARBITRATION PROCEDURE

2GRIEVANCE
- A grievance is defined as a contention of an
inequitable, inconsistent misapplication, or
violation of Federal or State Law.
3GRIEVANCE PROCEDURE
Any employee who believe she/he has been
aggrieved, may personally seek relief from that
conditions by filing a grievance.
- The employee shall be safe from restraint,
interference, discrimination, or reprisal.
4UNION REPRESENTATION
- The Unions, as Exclusive Representative, is
considered the prime representative of employees
in grievance matters and shall be notified of all
formal grievance hearings.
It is the policy of the Employers and the Union
to encourage discussion between
supervisors and employees.
5GRIEVANCE PROCEDURE
- Employees are encouraged to attempt to settle
problems through discussion with their immediate
supervisors.
In the event the problem is not resolved, a
formal grievance may be filed and shall be
processed in the following manner
6STEP ONE
- Grievance shall be reduced to writing and
submitted to the immediate supervisor of the
employee as quickly as possible (no more than 30
working days after the event or condition causing
employee to become aggrieved).
b. Every effort shall be made to resolve the
dispute at this level. In any event, the
immediate supervisor shall provide, through
personal service, a written decision within 7
days of the meeting.
7STEP TWO
- a. If the grievance is not resolved, the
employee and/or representative has 7 days after
receipt of Step One decision to submit grievance
to the District Director of Facilities.
b. The District Director of Facilities shall
meet with the employee and/or representative
within 7 days and provide a written decision to
the employee and the Union
8STEP THREE
- a. If the grievance is not resolved, it may be
taken to the Chief Executive Officer within seven
working days of receipt of Step Two Response.
b. The CEO shall meet with the employee and/or
representative within 7 days and provide a
written decision to the employees and the Union
within seven days.
9STEP FOUR
- If the decision of the CEO is unsatisfactory to
the employee, the grievance may be submitted to
the Washington Personnel Resources Board Rules
(within 30 days of the Step Three decision).
b. If mediation is unsuccessful, the Union may
request arbitration of the grievance by the Board
(within thirty working days).
10GRIEVANCE RESOLUTION
- Mediation and/or arbitration of a grievance
dispute shall not apply to those instances where
the same complaint has been filed for hearing
either through the unfair labor practices
procedures of the Washington Personnel Resources
Board Rules of appeal procedure of the Personnel
Appeals Board.
