State of Kansas SUBSTANCE ABUSE POLICY
Purpose Employees are the State of Kansas' most
valuable resource and, therefore, their health
and safety is of serious concern.
The State of Kansas will not tolerate substance
abuse or use which imperils the health and
well-being of its employees or threatens its
service to the public. The use of illegal drugs a
nd abuse of controlled substances, on or off
duty, is inconsistent with law abiding behavior
expected of all citizens. (This) threaten(s) the
state's ability to serve the public.
Employees have the right to work in a drug and
alcohol free environment. The state's goal is to
help employees become drug free and return to the
workforce as productive members.
Kansas will vigorously comply with the
requirements of the Federal Drug-Free Workplace
Act of 1988 and implement rules promulgated by
the United States Office of Management and
Budget. Policy It shall be the policy of the St
ate of Kansas to maintain a workforce free of
substance abuse. It is prohibited to use or distr
ibute illegal drugs or alcohol in reporting to,
at work, or on stand-by-duty, and may result in a
referral to the Employee Assistance Program or
discipline in accordance with appropriate
administrative regulations. Any employee who is c
onvicted of violating any criminal drug statute
in the workplace, must notify the state agency
head no later than five calendar days after such
conviction. Agencies that receive federal grants
or contracts must, in turn, notify federal
granting agencies in writing, within ten calendar
days of receiving notice from an employee or
otherwise receiving actual notice of such
conviction. Employees will be given a copy of the
Substance Abuse Policy. Assistance Program The
LIFEline Employee Assistance Program is available
to state employees and their families for
substance abuse education, counseling or
rehabilitation. Awareness Program The State of K
ansas will strive to educate employees about the
dangers of substance abuse. Applicability This S
ubstance Abuse Policy applies to all state
agencies. The term employees, as used in this
Substance Abuse Policy, means all classified and
unclassified state employees including student
employees at the Regent's institutions.
Effective Date This Substance Abuse Policy is eff
ective May 31, 1989. Revised 6/15/97

2- Why is the policy in place?
- Its mandated by federal law, as employees have
the right to work in a drug and alcohol free
environment.

- Who does it protect and why?
- It helps protect the state from liability in
lawsuits.
- It helps to act as a deterrent to potential
abusers of the policy.
- It protects employees of the state as to actions
of coworkers.
- It protects citizens and taxpayers with a stake
in the state.
- Who does the law effect?
- The law literally effects all Kansans, as theyre
either employees, taxpayers, or citizens dealing
with state employees.
- Who is exempt?
- No state employee is exempt.
3- 1 Joe Sixpack, who works for the state of KS (in
any capacity), got all liquored up at a church
picnic (he wasnt at work) Saturday the 4th of
July and got a DUI on his way home. He was
convicted of this on the 10th, but didnt report
this act to his supervisor until the 25th of
July. - Was this an infraction of Kansas Substance Abuse
Policy?
- No! Theyll find out, and wont be happy about
it, but the substance abuse incident didnt take
place on the job. Therefore he didnt have to
report it. - 2 This one is tougher. You are employed by KSU
Grounds as summer help (You know riding around
on one of those funny carts and pretending to
weed eat every now again). Your cohort, a wild
international student from a fictitious country
in South America, suggests that you both snort
cocaine and slam Jaegermeister throughout the day
to deter death by boredom. - Should you do this? Would it be against state
policy?
- Boredom is the only way to go folks. Enlighten
your friend, or remember to just say no!
Remember, its only funny until someone loses an
eye or their job.
