• Smoke-Free Arizona is a statewide voter
  initiative that will protect the health of all
  Arizonans from secondhand smoke.

• Smoke-Free Arizona will prohibit smoking in all
  enclosed public places and places of employment
  throughout Arizona.

Will Not

• Prevent political subdivision from adopting
  ordinance or regulations more restrictive.
• Repeal existing ordinance or regulation that is
  more restrictive.
• Apply to Indian Reservations.

Enforcement

• Arizona Department of Health Services
• Must promulgate rules for enforcement
• May delegate authority
• Fines of 100 to 500 for business
• Fine of 5,000 for extreme violations
• Fines of 50 to 300 for persons

• Paid for with 2 cent per pack tobacco tax

Why?

• Secondhand smoke is a serious public health
  threat.
• Each year approximately 53,000 Americans die from
  secondhand smoke.
• Classified as a Group A carcinogen.
• Particularly hazardous to elderly, and those who
  suffer from lung disease, cardiovascular disease,
  etc.
• No safe levels of secondhand smoke!

• Public Support for a Smoke-free Arizona is
  strong!
• A poll conducted by the national opinion
  research firm of Fairbank, Maslin, Maullin
  Associates in November 2003 shows

Why Now?

• 75 of Arizona voters support a proposed law
  that would prohibit smoking in all enclosed
  indoor workplaces in Arizona.

Why Now?

• Two-thirds (66) of Arizona voters who believe
  that restrictions on workplace smoking should be
  dealt with at the state level would prefer that
  the issue be submitted to voters statewide in the
  form of a ballot measure, rather than handled by
  the Governor and Legislature.

• The most credible messengers on proposals to
  limit smoking in workplaces according to poll
  respondents are
• 1) American Cancer Society, American Heart
  Association, American Lung Association
• 2) Emergency Room Doctors
• 3)The Centers for Disease Control and Prevention
• 4) The Arizona Hospital and Healthcare
  Association
• 5) Former Surgeon General Dr. C. Everett Koop

CurrentSituation?

• Seventeen cities/town/counties in Arizona have
  passed ordinances restricting smoking in enclosed
  public places and workplaces.
• Eleven states have passed laws restricting
  smoking in enclosed public places and workplaces
  California, Connecticut, Delaware, Maine,
  Massachusetts, Montana, New York, Florida, Idaho,
  Utah and Vermont.
