• By this time (June 2006) DFO had been notified
  several times by local citizens and the DSF, No
  action was taken.
• DFO simply claimed this one fell through the
  cracks
• DSF was advised that the project had been
  approved by the Regional District of Nanaimo and
  DFO was not notified (as it was supposed to be
  under DFO/RDN MOU)

• DFO wrongly advised DSF that Inspectors
  Directions had been issued to prohibit the
  proponent from dumping more fill when in fact no
  such action had been taken
• The only action taken by DFO was to have the
  proponent conduct an assessment of the amount and
  type of habitat that might have been lost and put
  together some sort of mitigation/compensation plan

• Meanwhile, DFO was advised by DSF in October,
  2006 of the existence of a report prepared in
  June, 2006 by an environmental consultant for the
  Regional District of Nanaimo
• That consultant recommended at that time that the
  proposed house building on the estuary lands be
  halted, the house footprint be moved and the
  already disturbed areas be rehabilitated
• RDN did nothing to change the project

• The impact assessment/compensation report that
  DFO requested that the proponent complete
  (according to local DFO officials the request was
  made in June 2006) was not submitted to DFO until
  July 2007!!!
• Meanwhile the house construction went on to
  completion with no changes whatsoever to the
  project design to minimize habitat loss.
• Here is the outcome (situation as of October
  2007))
