Rights of Recipients of Mental Health Services
  • Who are children in need of treatment

Basic Rights
  • Human, civil, and legal rights accorded all
    citizens.
  • Privacy assured and protected to greatest extent
    possible.
  • Religion, sexual orientation, race, creed,
    gender, national origin, political belief, or
    handicapping condition.

Individualized Treatment
  • Based on needs and delivered according to
    flexible models which accommodate changes in
    needs.
  • Never shall rights be treated as privileges to be
    earned.
  • Exercise these rights with no threat of reprisal,
    including denial of services.
  • All rights will remain intact unless specifically
    limited through legal proceedings.

  • LRE-Setting and Treatment, as appropriate to
    their needs.

  • Including all rights accorded them by ME statute,
    the Bates v. Peet Settlement Agreement, and these
    rules (above title from DBDS).

Informed Consent to Treatment
  • Recipients/Guardians have the right to informed
    consent for all treatment. This is why we use
    PET process to start Day Treatment Services.
  • All Recipients with unimpaired capacity have the
    right to consent to or to refuse treatment,
    absent an emergency.
  • Informed consent to treatment is obtained only if
    the client/guardian possess capacity to make a
    reasonable decision.

Freedom from Seclusion and Restraint
  • Children shall not be held in locked seclusion in
    an outpatient setting. Holding techniques shall
    only be utilized in outpatient settings pursuant
    to rules developed by the Dept. of Behavioral
    Developmental Services and DHS. (An approved
    holding technique)-MVP -Most Valuable Person.
