Future of Annex I to Directive 67/548/EEC

• Situation today
• Annex I to Directive 67/548/EEC contains
  harmonised classifications for different
  endpoints of a substance
• Based on the criteria for classification in
  Directive 67/548/EEC
• Situation in future from entry into force of GHS
  and REACH
• Directive 67/548/EEC (DSD)
• DSD including its Annexes will be repealed after
  a transitional period of X years
• DSD including its Annexes legally binding during
  transitional period for classifications based on
  the same Directive
• Transitional period will help downstream
  legislation to adapt, where needed, to the new
  system

New Annex for harmonised classification

• Situation in future from entry into force of GHS
  and REACH
• New Regulation implementing GHS
• New Annex with harmonised classifications at
  Community level according to the GHS criteria
• Including harmonised re-classifications for CMRs
  and respiratory sensitisers as foreseen in the
  REACH proposal
• However Presidency proposal 28 Oct. 2005 suggests
  that CL for other effects may be harmonised on a
  case-by case basis if justification is provided
  demonstrating the need for action at Community
  level

New tools for harmonisation of classification

• Situation in future from entry into force of GHS
  and REACH
• Harmonised classification in Annex I to Directive
  67/548/EEC should serve as minimum as a basis for
  the future list of harmonised classifications
  according to GHS criteria
• CL Inventory and database (Art.109 to 11 REACH)
• The tool for industry to agree classification for
  other endpoints and substances not harmonised at
  Community level
• Guidance under development to facilitate
  translation of classification according to
  existing EU system to the GHS system tables of
  equivalence
• Dual system during transitional period
