Background Information and Summary of Violations

• Prior Development Pre-commission nonconforming
  seasonal camp 40 ft. from the lake and shed.
  Vegetation throughout the lot, mostly scattered
  trees between the camp and the road and grass
  between camp and lake.
• July 2002 BP 11607 authorized removal of the
  existing camp and construction of a new seasonal
  camp 71 feet from the lake.
• The permit required removal of the existing camp
  and stabilization of the site. No additional
  filling or grading was authorized.
• A special condition specifically limited height
  of the new camp to 25 feet or less.
• June 2003 Staff discovered that the camp had
  been constructed 35 feet tall.
• October 2003 Staff discovered that filling and
  grading within 100 feet of the lake totaling 7000
  sq.ft. Approximately 900 sq.ft. was required for
  reclamation of the old building site.

Settlement Conditions

• Pay a civil penalty of 5,000 in two installments
  to be completed by 7/5/05. The penalty is reduced
  based on the respondents current financial
  situation. They have submitted support
  documentation.
• By 8/30/05 Plant a 25 foot wide buffer for
  screening. Mowing and other cutting is
  prohibited in the buffer.
• The property may not be sold without disclosure.
  
• - New owners are obligated to comply with the
  terms of SA.
• - The respondents must record this SA within 30
  days of ratification.
• - Upon any failure to comply with terms of the
  SA, seasonal camp must be removed.
