Requirements to Receive an Award

• U.S. small business with fewer than 500 employees
• Work must be performed in the U.S.
• Waiver only if the service/product is not
  available in the US
• Rare Exception
• Deviations from the requirements must be
  approved by the Contracting Officer

• During Phase I, at least 2/3 of effort must be
  performed by the proposing firm
• During Phase II, at least 1/2 must be performed
  by the proposing firm
• Principal Investigator must spend more than 1/2
  time employed by the proposing firm
• Deviations from the requirements must be
  approved by the Contracting Officer

SBIR Technical Data Rights Assertions Before
Award

• DFARS clause 252.227-7018 Rights in
  non-commercial Technical Data and Computer
  SoftwareSBIR Program will be included in
  resulting purchase order/contract
• Contract Specialist will send Provision
  252.227-7017 Identification and Assertion of
  Use, Release, or Disclosure Restrictions for
  completion prior to award
• 252.227-7017 will be attached to resulting award.
• If the contractor asserts rights on
  software/information, Legal, Technical Point of
  Contact (TPOC), and Program Office will review

ITAR Topics and Foreign Nationals

• International Traffic in Arms Regulation (ITAR)
• Denoted on specific topic
• No foreign nationals may work on the project
  unless they hold a Green Card
• ITAR clause is included in resulting
• purchase order/contract

National Defense Authorization Act for FY2008

• Delivery orders over 10,000,000, may be
  protested to the Government Accountability Office
  (GAO)
• Delivery orders over 5,000,000 Fair Opportunity
  unless certain circumstances exist
• Offerors can receive debrief

National Defense Authorization Act for FY2008

• No single award delivery order contract over
  100,000,000 may be awarded unless the Secretary
  of the Navy makes written determination
• All single award delivery order contracts less
  than 10,000,000 must be approved by chief of the
  contracting office
• Single Award delivery order contracts more than
  10,000,000 but less than 100,000,000 have to be
  approved by the HCA
• Local policy not developed to date
• Next quarterly meeting there will be update
