Background Information
  • Prior Development Pre-commission nonconforming
    camp 17 feet from the lake and a pre-commission
    combination camp/boathouse within 4 feet of the
    lake and a shed. Other development on the lot
    include a garage, set back 95 feet from the lake,
    constructed in the early 1980s. The two
    structures are served by an existing combined
    sewage disposal system installed in 1999.

Approved Activities
  • November 2003 BP 12231 authorized the removal of
    the shed and the replacement of the 16 foot by 33
    foot camp with a proposed 26 foot by 36 foot
    permanent home on a full foundation and a
    proposed deck (8 ft. by 10 ft.). The proposed
    home, with attached deck, was to be set back 52
    feet from the normal high water mark of Moosehead
    Lake.

Summary of Violations
  • January 2005 Commission staff conducted a site
    inspection and observed the permanent home with
    an attached deck with a full foundation had been
    constructed within 40 feet of the normal high
    water mark of Moosehead Lake, instead of the
    proposed and approved setback of 52 feet.

Settlement Conditions
  • Pay a civil penalty of 4,000.
  • By August 30, 2005 establish and maintain a
    buffer of screening vegetation between the
    permanent home and the normal high water mark of
    the lake.
  • Development of the lot is limited to the existing
    structures in their existing location.
  • The property may not be sold without disclosure
    and within 30 days of signature by all parties,
    this agreement shall be recorded in the Registry
    of Deeds.

  • Andrew Patterson has signed the settlement and
    agreed to the terms and conditions of the
    settlement agreement, including payment of the
    civil penalty.
  • Staff believe the agreement is fair and
    consistent with the Compliance and Enforcement
    Policy and request that you ratify the agreement.
