borough, county, district, association, or other
public body (created by State law) having
jurisdiction over disposal of sewage, industrial
wastes, storm water, or other wastes, including
special districts such as sewer districts, flood
control districts or drainage districts or
    similar entity
  • Designed or used for collecting or conveying
    storm water
  • Not a combined sewer, part of a POTW, or discrete
    system
  • Not authorized by other NPDES or TPDES permit

5
Phase II General Permit Definitions
  • MS4 Operator the owner or public entity that is
responsible for the management and operation of
the municipal separate storm sewer system and is
subject to the provisions of this general permit
  • Permittee the MS4 operator authorized under the
    general permit

6
Phase II General Permit
  • MS4s Eligible for Authorization by General
    Permit
  • MS4s located in an urbanized area (by 1990 or
2000 census) must obtain authorization for the
discharge of storm water runoff and are eligible
for coverage under the general permit.
  • Designated MS4s notified by TCEQ

Phase II General Permit
  • Regulated small MS4 operators must
  • develop, implement and enforce a Storm Water
Management Program (SWMP) to address the Minimum
    Control Measures
  • Submit NOI and SWMP to TCEQ

9
Minimum Control Measures
  • Public Education Outreach on Storm Water
    Impacts
  • Public Involvement / Participation
  • Illicit Discharge Detection and Elimination
  • Pollution Prevention / Good Housekeeping for
    Municipal Operations
  • Construction Site Storm Water Runoff Control
  • Post-Construction Storm Water Management in New
    Development and Redevelopment
  • Optional Authorization for Municipal Construction
    Activities

10
Minimum Control Measures
11
Public Education Outreach
  • Public Education Program, or Equivalent Outreach
    Activities to Inform
  • Residents
  • Visitors
  • Public service employees
  • Businesses
  • Commercial and industrial facilities
  • Construction site personnel
  • Document that reasonable attempt was made to
reach all constituents within the MS4

12
Public Education Outreach
  • Inform about
  • Impacts of polluted storm water runoff on water
    quality
  • Hazards associated with illegal discharges and
    improper disposal of wastes
  • Ways to minimize their impact on storm water
    quality.

13
Public Education Outreach
  • Recommended
  • Use existing educational materials provided by
EPA, State, environmental, public interest, trade
    organizations, or other MS4s
  • See
  • http//cfpub.epa.gov/npdes/stormwatermonth.cfm
  • and www.cleanwaterclearchoice.org (local)

14
Public Involvement in SWMP Development
  • Identify and implement a public involvement and
    participation program
  • Allow opportunities for all constituents within
the MS4 area to participate in the SWMP
    development and implementation

15
Public Involvement
  • At a minimum, comply with State/Local notice
    requirements
  • Document that sufficient opportunities were
provided to involve all constituents interested
in participating in the program process

16
Illicit Discharge Detection/ Elimination
  • Develop, implement enforce program to detect
    eliminate illicit discharges
  • Techniques to detect illicit discharges
  • Regulate non-storm water discharges
  • Enforcement procedures/actions
  • Storm drainage system map

17
Illicit Discharge Detection/Elimination
  • Storm Drainage System Map
  • Locate storm sewer pipes, ditches, other
conveyances (or at a minimum, the outfall's
    drainage area)
  • Locate all major outfalls
  • Inner Diameter 36 inches or equivalent or
drainage area of gt 50 acres
  • Inner Diameter 12 inches or drainage area gt 2
    acres in areas zoned industrial
  • Name and locate all waters of the US that receive
    discharges from the outfalls
  • Document source of information

18
Pollution Prevention/Good Housekeeping for
Municipal Operations
  • Operation and maintenance program with goal of
conducting municipal operations in a manner to
prevent or reduce pollution in storm water runoff
  • Controls to reduce or eliminate discharge of
pollutants when the runoff from municipal
operation is determined to be a significant
    contributor to the MS4

19
Pollution Prevention/Good Housekeeping for
Municipal Operations
  • Examples of municipal operations areas
  • Parks/open spaces
  • Street maintenance
  • Fleet and building maintenance
  • Storm water system maintenance
  • New construction land disturbances
  • Municipal parking lots
  • Vehicle and equipment maintenance and storage
    yards
  • Water transfer stations
  • Salt/sand storage

20
Pollution Prevention/Good Housekeeping for
Municipal Operations

  • Training
  • Directed at preventing and reducing storm water
    pollution from municipal operations
  • Structural control maintenance
  • List activities, schedules, inspections
  • Proper disposal of waste
  • Dredge spoil, sediment, floatables, etc.
  • Industrial operations
  • Wastewater treatment plants, solid waste, etc.

21
Construction Site Storm Water Runoff Control
  • Develop, implement and enforce a program to
reduce pollutants in runoff from construction
    activities disturbing gt1 acre
  • (or smaller site, if part of a larger common
    plan of development)
  • Require construction site operators to implement
erosion sediment control BMPs to control
    waste

22
Construction Site Storm Water Runoff Control
  • Ordinance, sanctions to ensure compliance
  • Procedures
  • Site Plan Review
  • Receipt consideration of information submitted
    by the public
  • Site inspection / enforcement of controls

23
Post-Construction Storm Water Management for New/
Redevelopment
  • Develop, implement enforce program for storm
water runoff from New Re-development projects
that disturb gt1 acre (or smaller projects that
are part of a larger common plan)
  • Prevent or minimize water quality impacts
  • Ordinance to address post-construction runoff
  • Structural non-structural BMPs appropriate to
    community
  • Ensure adequate long-term operation maintenance

24
Authorization for Municipal Construction
Activities
  • Alternative to seeking coverage under
    Construction General Permit TXR150000
  • When permittee meets the definition of
    "Construction Site Operator"
  • Describe
  • How construction activities generally will be
conducted, taking local conditions into account

    Minimum Control Measure
  • Describe how each Measurable Goal will be
    evaluated
  • Provide rationale statement that addresses the
overall program and how the BMPs and Measurable
    Goals were selected
  • Provide a schedule for implementation of SWMP

27
Recordkeeping Reporting
  • Retain all records pertaining to the permit for
three years or the length of the permit,
    whichever is longer
  • Make records available to the public and to TCEQ
    upon request
  • Update information provided to TCEQ as changes
    occur
  • Notify TCEQ of noncompliance within 24 hours
