12Factors Favoring Approvalof the Special Use
Permit
- 1.) The testing facility complies with the
comprehensive plan. - 2.) The testing facility complies with the
purpose of the zoning district. - 3.) The impacts of the testing facility on local
infrastructure are negligible. - 4.) The special use involves no hazardous
materials. - 5.) The activities associated with the testing
facility contribute to the local economy. - 6.) One local resident has expressed support for
the application to staff in the Planning
Department.
13Factors Favoring Denialof the Special Use Permit
- 1.) The testing facility has created off-site
impacts that have apparently been a nuisance to
residents of the area. - 2.) The exact nature of future testing activities
is uncertain. - 3.) Two local residents have expressed
opposition to the application to staff in the
Planning Department.
14Staff Recommendation
- The Planning Department recommends that the PZ
Commissions approval of Raytheons request for a
special use permit to allow outdoor testing of
weapons systems on Parcel 209-23-003 be upheld by
the BOS, subject to the following conditions
15Special Use Permit (recommended conditions of
approval)
- 1.) Future testing projects shall be of a similar
nature to that currently underway, shall not
involve any hazardous materials or ordnance, and
shall not increase the off-site impacts
associated with the current use. - 2.) Any changes to the approved special use shall
be subject to review by the Planning Department
and may require modification and approval by the
Planning and Zoning Commission.

- 3.) Any future permanent structures will require,
at a minimum, a building/use permit and review by
staff for conformance with this special use
permit. - 4.) A revised site plan that adequately indicates
the location and dimensions of driveways and
parking facilities shall be submitted to the
Planning Department prior to issuance of the
special use permit.

- 5.) Prior to permit issuance, the applicant shall
enter into a private maintenance agreement with
the County for W. Dry Tumbleweed Ln. - 6.) The applicant shall obtain a floodplain use
permit prior to issuance of the special use
permit. - 7.) Cut sheets of on-site light fixtures
indicating compliance with the Countys light
pollution code shall be submitted to the Planning
Department prior to issuance of the special use
permit.

- 8.) The applicant shall take effective measures
to control fugitive dust generated at the testing
site. - 9.) It is the applicants responsibility to
obtain any additional permits, or meet additional
conditions, if any, that may be applicable to the
testing facility pursuant to other federal,
state, or local laws or regulations.

- 10.) The driveway leading from W. Dry Tumbleweed
Lane to the testing site and the parking area at
the testing site shall be surfaced with two
inches of gravel. - 11.) West Dry Tumbleweed Lane (between N. High
Grove Lane and the driveway into the subject
parcel) shall be surfaced with two inches of
gravel.

- 12.) Vegetative screening, including but not
limited to fast-growing trees and shrubs, shall
be planted along the boundaries of the subject
parcel that abut the appellants property. - 13.) The applicant shall regularly provide a
schedule of testing activities to the appellant
and shall not conduct any testing on weekends or
national holidays or between the hours of 6 p.m.
and 8 a.m.
