- Provide a general overview of MAPPA and Non MAPPA
- Explain how the Learning Disabled Offender fits
into these arrangements - Explain how MAPPA engages with services for
Learning Disabled Offenders
3What is MAPPA?
- Managing risk in a multi-agency way and also
managing risk at lowest level possible - Ensuring that all relevant offenders are risk
assessed and risk managed - Making defensible decisions in regard to level
of risk management of all relevant offenders
4Where does the authority come from?
The Criminal Justice and Court Services Act
2000, sections 67 and 68, placed a statutory
duty upon Police and Probation, the
Responsible Authority,to establish arrangements
for the purpose of assessing and managing the
risks posed by
5relevant sexual and violent offenders
AND other persons who by reason of offences
committed by them( wherever committed), are
considered by the Responsible Authority to be
persons who may cause serious harm to the public

7What is the MAPPA Framework?
- Identification of offenders
- Sharing of relevant information
- Assessment of the risk of serious harm
- Management of that risk
8Who are the Relevant Offenders?
- Category 1 registered sex offenders
(convicted or cautioned since 1st September 1997
or in custody for a like offence at that point in
time) - Category 2 violent and other sex
offenders( sentenced to 12 months or more
imprisonment since the 1st April 2001 or in
custody for a like offence at that time) - Category 3 other offenders
9Who are other offenders under Category 3?
Other offenders considered by the Responsible
Authority to pose a risk of serious harm to the
public
10Who are other offenders under Category 3
Firstly Must have a conviction for an offence
which indicates offender is capable of causing
serious harm to the public
AND Secondly Responsible Authority must
reasonably consider that the offender may cause
serious harm to the public
11What constitutes serious harm?
Defined as a risk which is life threatening and
/or traumatic, and from which recovery, whether
physical or psychological, can be expected to be
difficult or impossible

- general public
- children

13Category 3 Offenders
Referrals could come from any agency
including Social Services, Health and Housing
14What are the levels of Risk Management?
- Level 1 ordinary risk management
- Level 2 local inter-agency risk
management ( Risk Management Meeting) - Level 3 Multi-Agency Public Protection Panel
( MAPPP)
15What is ordinary risk management?
- sex offender managed by the Police
- post release licence managed by Probation
16What is local inter- agency risk management?
The active involvement of more than one agency is
required, but either the level of risk or the
complexity of managing the risk is not so great
as to require referral to level 3 MAPPP
17What is the MAPPP?
The MAPPP is responsible for the critical
few ie i) the offender is assessed under OASys
as being a high or very high risk
AND ii) presents risks that can
only be managed by a plan which requires
close co-operation at a senior level
18 OR the offender, although not
assessed as high risk is exceptional because of
the likelihood of media scrutiny and/or public
interest
19How do cases exit from MAPPA?
Category 1 Automatic de-registration at end
of sex offender registration
Category 2 Automatic de-registration at
end of post release
licence
20 UNLESS offender is still
considered by Responsible Authority to pose a
risk of serious harm to the public. If
so,offender will remain in the MAPPA under
Category 3 until the risk is reduced
21How do we transfer cases?
Cases subject to the MAPPA may be
transferred between areas and this transfer must
be secure enough to ensure that the risk posed
by these offenders is constantly managed at all
times
22How do we transfer cases?
- offenders subject to Probation statutory
supervision will be transferred via the
Assistant Chief Officer in both exporting and
receiving Probation areas( level 2 or 3 ) -
other offenders will be transferred via the
MAPPA co-ordinators in both the exporting
and receiving Probation/Police Areas ( level
2 or 3 )

24Who is included in the duty to co-operate?
- Local Authority Social Services Departments
- Primary Care Trusts, other NHS Trusts and
Strategic Health Authorities - Jobcentre Plus
- Youth Offending Teams
- Registered Social Landlords which accommodate
MAPPA offenders

- Local Education Authorities
- Electronic Monitoring Providers
26What does duty to co-operatemean?
- formalises good practice
- co-operation is compatible with existing
statutory functions of the bodies listed - not new function but requires collaborating with
other bodies involved
27What does this mean in practical terms?
- involves attending case conferences
- providing advice about the assessment and
management of particular cases - advising, from each agencys professional
perspective, on the broader issues which may
affect the operation of the MAPPA generally - sharing relevant information to enable RA and
other agencies to work together effectively
28How do we deal with unconvicted people considered
to pose a risk of serious harm to the public?
Individuals with NO
CONVICTIONS
OR who HAVE been
convicted of an offence BUT
nature of offence does NOT indicate that they
pose a serious risk of harm to
the public. CANNOT BE DEALT WITH UNDER
MAPPA PARALELL SYSTEM HAS BEEN ESTABLISHED
29Where does the authority come from?
Crime and Disorder Act 1998 sec 115
This section puts beyond doubt the power of
any organisation to disclose information to
Police Authority, Local Authority, Probation
Committee, Health Authority, or to persons acting
on their behalf, so long as such disclosure is
necessary or expedient for purposes of this act.
i.e prevention, detection and reduction of crime
30What are the Non MAPPA procedures?
Anyone considered to pose a risk of serious harm
to the public, who does not have a conviction or
does not have a relevant conviction, should be
considered by the police for risk
management Identification of individual Referra

information and decides whether Risk Management
is appropriate and records defensible decisions
31What are the Non MAPPA procedures?

32What is a Special Case Conference?
Sharing of information, assessing level of risk
and devising a plan to manage that risk The Act
( CD Act 1998) provides agencies,
including Police, Health, Probation and Social
Services with the power to disclose information
for the prevention,detection and reduction of
crime It also provides these bodies with the
power to use this information
33How does the Learning Disabled Offender fit into
these arrangements?
Within MAPPA, learning disabled offenders are no
different to other offenders who fit the
criteria.
