  • The US government cannot act in an unfair manner
    or disobey established rules.
  • Substantive due process deals with the procedures
    of government action and procedural due process
    deals with the policies of government action.
  • People must be given due process.

  • The States have police power which is the
    authority to protect and promote the public
    safety.
  • The police power sometimes conflicts with civil
    rights protection.
