What is Mediation?

• A process whereby a neutral third party acts to
  encourage and facilitate the resolution of a
  dispute between two or more parties where they
  can reach a mutually acceptable and voluntary
  agreement. The decision making authority rests
  with the parties in conflict.
• Conflict is an inevitable part of our lives, and
  mediation can play a vital role in the peaceful
  resolution of such conflicts.

• Voluntary
• Informal
• Non adversarial
• Interactive
• Encourages parties to take responsibility
• Fosters joint problem solving
• Explores settlement alternatives (Win-Win)

Steps in the Mediation Process

• The beginning pre-mediation set-up
• Mediators opening statement
• Accumulating information parties recount what
  has brought them to mediation
• Assist parties in organizing agenda for the
  mediation (always subject to revision)
• Generate movement, consider creative alternatives
• Ending the mediation written agreement
