special education records are forwarded to the
person making disciplinary decisions at the
campus and/or district level. NEXT
4- AN ARD COMMITTEE MEETS TO ADDRESS THE FOLLOWING
IF REQUIRED - MANIFESTATION DETERMINATION
- FBA/BIP,
- DOCUMENTATION OF AGREEMENT BETWEEN PARENTS AND
SCHOOL PERSONNEL CONCERNING THE PROPOSED CHANGE
OF PLACEMENT, AND - FAPE
5(1) IF THE ARD IS SEEKING A LONG TERM AEP
PLACEMENT (MORE THAN 30 DAYS) OR EXPULSION, as a
disciplinary consequence for a situation where
the behavior is not a manifestation of the
disability THE ARD WILL REFER TO THE DISTRICT
HEARING OFFICER TO REVIEW THE CASE AND RECOMMEND
A SPECIFIC NUMBER OF DAYS BACK TO THE ARD
COMMITTEE.
6(2) IF THE ARD IS SEEKING A LONG TERM AEP
PLACEMENT (MORE THAN 30 DAYS) as a behavioral
management intervention for a situation where the
behavior is a manifestation of the disability

OFFICER TO REVIEW THE CASE AND RECOMMEND A
SPECIFIC NUMBER OF DAYS (the campus diagnostician
should attend this district level hearing)

PLACEMENT, THE ARD NEED NOT MAKE A SPECIFIC
RECOMMENDATION OF DAYS TO THE DISTRICT HEARING
OFFICER (WHICH IS THE PROCEDURE USED WITH ALL
STUDENTS). NEXT
8THE DISTRICT DUE PROCESS PROCEDURE CONTINUES WITH
A REVIEW BY A DISTRICT HEARING OFFICER WHO MAKES
A SPECIFIC RECOMMENDATION TO THE ARD
COMMITTEE. NEXT
9- THE ARD COMMITTEE MEETS AGAIN TO ADDRESS
AND/OR REVIEW - MANIFESTATION DETERMINATION (IF REQUIRED)

PLACEMENT WILL BE MORE THAN 30 DAYS
10If parents and school personnel agree about a
proposed change of placement for disciplinary
reasons, the rules concerning the amount of time
that a child with a disability may be removed
from his or her educational placement in Secs.
300.520 (removals for more than 10 / 45 days) and
300.521 (removal by TEA hearing officer) do not
have to be used. However, services must be
provided consistent with the requirements of Sec.
300.121(a) (provision of FAPE). Agreement of
change of placement beyond 10 / 45 days, needs to
be documented by the ARD/IEP process. (note that
the manifestation determination review,
Sec.300.523, will still need to be processed, if
required)
