Pre-PAR IP Ad Hoc Background
  • Pre-PAR Activities (e.g. Study Groups) are
    Sponsor initiated (rather than Standards Board
    initiated) standards related work activities.
  • Sponsors have the authority to initiate short
    term projects which may
  • Lead to a Standards Board authorized PAR, or
  • Provide initial work products for a subsequent
    Work Group to evaluate, or
  • Terminate without resulting in a proposed PAR.
  • While the Pre-PAR Activity is a recognized
    IEEE-SA activity, Pre-PAR Activity is not
    required to, and does not operate under the rules
    imposed by the Standards Board for standards
    development activities.
  • Sponsors have an obligation, however, to ensure
    that the Pre-PAR Activity is legitimately
    pre-PAR.
  • Work that should be performed in a properly
    organized and regulated standards development
    activity should not be pushed down into Pre-PAR
    Activity.

Pre-PAR IP Ad Hoc Observations
  • Pre-PAR Activities are Sponsor Chair initiated
    for a period of not more than six months.
  • Pre-PAR Activities may be initiated according to
    a loosely defined charter.
  • Pre-PAR Activities have recognition within the
    IEEE-SA
  • Can be covered by IEEE-SA indemnification
  • Have Sponsor oversight for work product
    development
  • Pre-PAR Activity work products are not approved
    by the IEEE-SA Board, are not introduced into an
    IEEE-SA Board process, and are not approved for
    standards track development under NesCom.
  • Pre-PAR Activities are not registered within the
    IEEE-SA
  • Pre-PAR Activities would only be recognized and
    registered by the Sponsoring organization.
  • Pre-PAR Activities normally perform one or more
    of the following work efforts
  • PAR development.
  • Initial standards project work activity that can
    potentially transfer to standards track activity.
  • Research in preparation for a planned standards
    activity.
  • Other pre-standards and technology scoping
    activities.
  • Pre-PAR Activities normally have an organization
    / voting / participation structure of some form
    (may be informal, defined by the sponsor, or
    defined by Pre-PAR activity participants) and
    have a Pre-PAR Activity chair. The structural,
    organizational, and voting structures are at the
    discretion of the organizing sponsor.

Pre-PAR IP Ad Hoc Conclusion
  • IEEE-SA Intellectual Property Policy does not
    currently address, define nor accommodate
    Intellectual Property Guidelines for Pre-PAR
    Activities.
  • Recommendations from this Ad Hoc for Pre-PAR
    Intellectual Property Management Proposals would
    be inconsistent with current IEEE-SA defined
    policy

  • Current IEEE-SA Policy defines
  • When an approved Standards Project Initiates
  • PAR Approval
  • When an LOA can be accepted
  • Post PAR Approval
  • A subsequent Pre-Par Task Team should be
    established, with a set of defined parameters, to
    evaluate the current IEEE-SA Patent Policy.
  • Determine If and How Pre-PAR Intellectual
    Property Policy should be addressed.
  • Determine whether the IEEE-SA Patent Policy
    should be modified to address Pre-PAR activities.
  • Evaluate whether ProCom needs to address Process
    and Procedure for Pre-PAR activity to be
    consistent with Pre-PAR Intellectual Property
    process considerations.
  • Charter the existing Ad Hoc to continue as a Task
    Team to evaluate Pre-PAR Intellectual Property
    process.
