WHAT HAPPENED? WHY DID OREGON END UP WITH
MEASURE 37?
  • Pro- Measure 37 propaganda was focused on one
    individual devoid of connection with any
    community
  • Proponents messaging portrayed the individual as
    a victim of government regulation the
    government wouldnt let poor Dorothy build a home
    for her son
  • Proponents property rights story preyed on
    voters general misunderstanding of regulatory
    takings and talked about fairness as meaning that
    the government cannot take away my individual
    rights.

INDIVIDUAL RIGHTS (DESIRES) WERE PITTED AGAINST
COMMUNITY PROTECTIONS AND GENERAL WELFARE
  • Proponents message evoked emotional responses
    from voters empathy for the individual, anger
    toward government regulation.
  • The underlying intention to dismantle community
    safeguards and governments ability to protect
    the public interest went unnoticed by voters.
  • Voters and neighbors were led to believe that
    individual desires equal individual rights.
  • Voters trusted their neighbors and didnt
    understand that laws already protect citizens
    property from being taken away by government
    actions.

VOTERS WERE LURED BY PROMISES OF GOVERNMENT
PAYOUTS
  • Oregonians thought their vote for measure 37 was
    a vote in support of their neighbors right to
    build a home for a family member.
  • Efforts to educate voters about measure 37
    impacts failed to convince them that the measure
    would roll back land use protections, subdivide
    all of rural Oregon, and government would never
    pay a dime to their neighbors.
  • More than 2 years after the measure passed, many
    Oregonians who voted for measure 37 say they were
    tricked and that their rights as neighbors are
    being violated by measure 37 waivers.

THE SAD BUT TRUE AFTERMATH MEASURE 37 IS
UNFAIR TO NEIGHBORS
  • Measure 37 waivers have turned neighbor to
    neighbor responsibility and accountability on its
    head.
  • Voters lack of trust in government has been
    agitated by issuance of waivers now their
    rights are being violated.
  • Measure 37 directs that local and state
    governments are financially responsible for
    claimants legal costs if their demands are
    unmet, denied, or even partially approved.

WHATS A NEIGHBOR TO DO?
  • Measure 37 offers little if anything for
    neighbors and communities.
  • Neighbors who oppose measure 37 waivers based on
    infrastructure concerns (water, septic,
    ingress/egress) are told their concerns are
    irrelevant.
  • Meanwhile, instances of unpermitted measure 37
    developments plague neighbors and communities
    throughout the state.
  • Neighbors throughout Oregon are lobbying their
    state legislators for relief from the negative
    impacts imposed on communities as a result of
    measure 37 waivers.

OREGONS FUTURE WHERE DO WE GO FROM HERE?
  • The legislature has heard from voters and is
    considering a fix for measure 37.
  • Governments ability to regulate the use of land
    on behalf of the public must be restored our
    responsibility to future generations depends on
    it.
  • Its time for voters to re-envision the future of
    their Oregon and their communities a future
    that is now imperiled by developers and monied
    interests.
  • Voters need and deserve access to clear and
    unbiased information about ballot measure
    initiatives.
