Service of Notices
  • Service of Notices specified in Law of Property
    Act 1925 section 196
  • Registered post
  • Recorded delivery
  • Hand delivery (deemed delivered the next working
    day if before 5pm)
  • May add first class post (deemed delivered 2
    working days later)
  • Otherwise Personal Service!

Section 21 Notices
  • Gives the landlord mandatory repossession
  • Do NOT serve before the tenancy starts
  • MUST be a minimum of 2 months
  • Expires at the end of the fixed term or 2 months
    after service if served during the fixed term
  • Periodic tenancy- The notice MUST expire at the
    end of a period of the tenancy
  • Notice should not be served until the landlord
    wants possession

  • Tenant gives 1 months notice in a periodic
    tenancy if pays rent monthly
  • Cannot be held to a longer period
  • Acceptance of keys may be surrender
  • Notice to Quit required for a non-housing act
    tenancy
