Facility Responsibility
  • CRADLE TO GRAVE
  • The Resource Conservation and Recovery Act (RCRA)
    enacted in 1976 yielded a complex assortment of
    regulations governing the management of hazardous
    waste from "cradle to grave". 
  • Accurate waste determination is the foundation of
    your waste management program.  Familiarizing
    yourself with applicable waste determination laws
    and regulations will help to ensure a solid start
    to proper waste management.

Storage Containers
  • Establish good housekeeping practices to avoid
    possible spills. Follow these requirements for
    handling storage containers
  • Containers must be in good condition
  • Replace leaking containers
  • Containers must be compatible with the hazardous
    waste stored in them, and must meet U.S. DOT
    standards
  • Containers holding hazardous waste must be closed
    during storage
  • Do not handle containers in a haphazard way that
    could cause leaking or rupture

Selecting a Transporter

    liability insurance coverage (required by DEP)

DPNR PERMIT REQUIREMETS

PERMITTING
  • VI Rules Regulations 1560-501
  • Mandates that any person/entity who generates,
    stores, transport and/or treat hazardous waste
    must obtain a permit from DPNR for such
    activities.
  • Permit permits contain detailed conditions under
    which a permittee is allowed to conduct the
    permitted activities.
  • Permit must made be available for presentation to
    DPNR-DEP upon inspection of your facility.
  • Compliance inspections are for the purpose of
    monitoring compliance with permit conditions.

PERMIT REQUIREMENTS
  • Compliance Inspection
  • Individuals handling waste must be certified in
    accordance with territorial and federal law
  • Must provide site access to DPNR personnel
  • Store waste pursuant to waste category
  • Safety equipment on site
  • Utilize DPNR permitted entity
  • Storage facility must be secured
  • Must provide inspector records upon request
  • Report spills to DPNR within forty eight (48)
    hours
  • Permit is not transferable
