Why a WEEE Directive?

From the Directive The amount of WEEE
generated in the Community is growing rapidly.
The content of hazardous components in electrical
and electronic equipment (EEE) is a major concern
during the waste management phase and recycling
of WEEE is not undertaken to a sufficient extent.

  • the Waste Electrical and Electronic Equipment
    (WEEE) Regulations 2006 - UK SI.2006 No. 3289
  • - cover product marking, take-back and recycling
    obligations, etc for the UK
  • the Waste Electrical and Electronic Equipment
    (Waste Management Licensing) (England and Wales)
    Regulations 2006 SI. 2006 No.3315
  • - cover treatment and site licensing in England
    and Wales
  • - there will be separate provisions for Scotland
    and Northern Ireland

Who is a Producer?
  • Producers are people who
  • import electrical and electronic equipment (EEE)
    on a professional basis
  • make and sell EEE under their own brand or
  • re-brand and sell EEE
  • for the WEEE Regulations, its the UK market that
    matters

What will Producers need to do?
  • by 15 March 2007, join an approved Producer
    Compliance Scheme
  • by 31 March 2007 apply to be a registered
    Producer
  • pay an annual registration fee of
  • 445 - businesses with a turnover over 1m
  • 220 - businesses above VAT threshold but less
    than 1m turnover
  • 30 - businesses below the VAT threshold
  • from 1 July 2007, pay for a portion of separately
    collected household WEEE to be treated and
    recycled

What else will Producers need to do?
  • supply data on the types and quantity of new EEE
    placed on the market (103 categories for B2B,
    and B2C)
  • provide information on the dismantling and
    recycling of new products
  • mark all new EEE with a crossed-out wheelie bin
    symbol and producers identification mark

What else?
  • every producer will receive a unique producer
    number this must be quoted when supplying goods
    to a distributor
  • producers will need to maintain records of EEE
    placed on the UK market

Producer Compliance Schemes
  • 37 Schemes have been approved - details are
    available to download from our web site
  • schemes can be B2C, B2B or both. They can be open
    to all producers or limited to a single company
  • they are an important communications channel for
    us and can report back on any common
    misunderstandings or areas where further guidance
    is required

All are approved throughout the UK

Whos responsible for non-household WEEE?
  • for waste from equipment purchased before 13
    August 2005, the end user is responsible for
    treatment and recycling, unless they are buying
    replacement products in which case the producer
    supplying the new equipment will have these
    responsibilities
  • for equipment put on the market after 13 August
    2005, the producer supplying that equipment will
    have to take responsibility unless both parties
    negotiate alternative arrangements

WEEE Treatment and Recovery
  • separately collected WEEE must be treated -
    essentially to remove fluids and specified
    hazardous substances
  • Removal not defined in the Directive or UK
    Regulations
  • for most items, removal as whole items likely to
    be required
  • treatment guidance has been produced by Defra,
    WAG and the Scottish Executive

Licensing and Exemptions
  • all licensed WEEE treatment facilities will have
    to meet the WEEE Directives treatment and
    infrastructure requirements by 1 July 2007
  • some operators will need to apply for a licence
    modification before 1 July in order to continue
    treating WEEE beyond that date
  • application forms for the 3 new WEEE exemptions
    are available to download from our website at

Approval of ATFs and Exporters
  • only approved ATFs and approved Exporters are
    able to issue evidence of WEEE treatment and
    recycling
  • approval lasts for one compliance period
  • there is a charge to pay 2,590 (or 500 if
    issuing evidence for 400t or less)
  • applications can be made at any time
  • the Regulations allow a determination period of
    up to 12 weeks. Evidence cant be issued until
    the operator has been approved
  • at the end of the compliance period, an approved
    ATF or exporter must appoint an independent
    auditor to confirm the validity of the evidence
    issued

Enforcement
  • we will be guided by our enforcement and
    prosecution policy
  • our current focus is getting producers into
    Schemes and registered - compliance not
    prosecution is the objective
  • producers, distributors, end-users, treatment
    sites, local authorities, and exporters shouldnt
    overlook existing controls that will continue to
    apply
