- Environment Protection (Prescribed Waste)
Regulations, 1998 - Classify certain wastes to be prescribed for
the purposes of the Act - Establish regulatory controls over aspects of the
management of Prescribed Industrial Waste, eg.
transport - Establish responsibilities and reporting
requirements for industrial waste producers
5Responsibilities in Brief
- Transport Disposal
- EPA Publication 364 sets out the rules for
asbestos management. - In summary EPA regulates controls
- the transportation of asbestos of industrial
origin and - the final disposal destination (landfill) of
waste asbestos, whether of industrial origin or
domestic origin.
6Transporter Responsibilities
- Owners of vehicles that transport industrial or
commercially sourced waste asbestos must hold a
waste transport permit. - The permit will stipulate necessary controls for
the safe handling, transport and disposal of
waste asbestos. - Packaging material must be protected and remain
intact during transport and unloading. Damaged
packaging must be replaced or repaired prior to
disposal of the consignment.
7Tracking Requirements
- Waste Transport Certificates
- The waste producer must generate a waste
transport certificate. -
- The waste transporter and disposal/receiving site
operator must complete the appropriate sections
of the certificate
8Defining Asbestos Sources
- Under the Environment Protection (Prescribed
Waste) Regulations 1998 asbestos from industrial
origins are prescribed industrial waste. - When a commercial contractor (e.g. a licensed
asbestos removalist) undertakes the removal of
the asbestos from a domestic source transport
certificates and a permitted vehicle are
required.
9Defining Asbestos Sources
- The transportation of domestic-sourced asbestos,
unless removal is undertaken by a licensed
asbestos removalist, does not fall within EPAs
statutory responsibilities. - A householder may transport their own asbestos to
a licensed landfill for disposal with out
transport certificates or a permitted vehicle.
10Disposal
- Scheduled Premises Regulations
- Sets out those premises which are scheduled
- e.g. Premises receiving Prescribed Industrial
Waste - Sets out the conditions under which certain
premises may be exempt - e.g. composting works are exempt from licencing
- Identifies those premises that EPA has a primary
regulatory relationship with.
11Disposal
- Storage Prior to Disposal
- Local Govt can establish a facility to provide
consolidation point ie at a transfer station - No Works Approval required
12Disposal
- Asbestos must be disposed of only at landfill
sites licensed by EPA to accept waste asbestos. - Persons (both industrial and domestic sourced)
intending to dispose of waste asbestos should
contact the site operator to ascertain the
capability of accepting the waste. - Licence conditions ensure waste asbestos be
handled and covered in such a manner to ensure it
is not disturbed
