21987 PHILIPPINE CONSTITUTION Provisions Related
to Science and Technology Article XIV- Education
3Section 3 (1) All educational institutions shall
include the study of the Constitution as part of
the curricula. (2) They shall
inculcate patriotism and nationalism, foster love
of humanity, respect for human rights,
appreciation of the role of national heroes in
the historical development of the country, teach
the rights and duties of citizenship, strengthen
ethical and spiritual values, develop moral
character and personal discipline, encourage
critical thinking, broaden scientific and
technological knowledge, and promote vocational
efficiency.
4- Section 10. Science and Technology are essential
for national development and progress. The state
shall give priority to research and development,
invention, innovation, and their utilization and
to science and Technology education, training,
and services. It shall support indigenous,
appropriate, and self- reliant scientific and
technological capabilities, and their application
to the countrys productive systems and national
life.
5- Section 11. The Congress may provide for
incentives, including tax deductions, to
encourage private participation in programs of
basic and applied scientific research.
Scholarships, grants-in-aid, or other forms of
incentives shall be provided to deserving science
students, researchers, scientists, inventors,
technologists, and specially gifted citizens.
6- Section 12. The state shall regulate the
transfer and promote the adaptation of technology
from all sources for the national benefit. It
shall encourage the widest participation of
private groups, local governments, and community-
based organizations in the generation and
utilization of science and technology.
7- Section 13. The state shall protect and secure
the exclusive rights of scientists, inventors,
artists, and other gifted citizens to their
intellectual property and creations, particularly
when beneficial to the people, for such period as
may be provided by law.

- AN ACT ESTABLISHING PROVINCIAL CENTERS FOR
SCIENCE AND TECHNOLOGY IN ALL PROVINCES OF THE
PHILIPPINES AND - APPROPRIATING FUNDS THEREFOR
10Section 1. It is the policy of the State to
accelerate the application and transfer of the
benefits of modern science and technology,
particularly to the rural areas, so that the
great majority of our people, through higher
productivity and increased earning power, improve
the quality of their lives.
11Section 2. In pursuance of the policy enunciated
in the preceding provision, there is hereby
established, under the direct supervision of the
Department of Science and Technology in all
provinces of the Philippines. Whenever
practicable, such centers shall be established in
state colleges or universities specializing in
science and technology courses, appropriate local
government units, or private institutions of
proven capability in science and technology.
12Section 3. The science and technology centers are
extensions of the 13 regional offices of the
Department of Science and Technology.
13 REPUBLIC ACT NO. 7687 AN ACT INSTITUTING A
SCIENCE AND TECHNOLOGY SCHOLARSHIPS PROGRAM AND
FOR OTHER PURPOSES Section 1. Title- This act
shall be known as the Science and Technology
Scholarship Act of 1994.
14Section 3. General Objectives- To carry out the
foregoing policy, this Act strengthens the
countrys science and technology manpower by
creating a pool of scientists, engineers and
technicians who shall fill the needs of
industrialization. Towards this end, scholarships
shall be provided to finance the education of
poor, talented and deserving students desiring to
pursue a degree or training in areas of science
and technology as are recognized or permitted by
law.
15Section4. Science and Technology Scholarship
Fund. There is hereby created as Science and
technology Scholarship Fund, hereinafter known as
the Fund, to be administered by the Department of
Science and Technology (DOST). Section 5.
Appropriations- The amount necessary to carry out
the initial implementation of this Act, shall be
charged against the current Fiscal year
Appropriations of the DOST.
16Section 6. Coverage- The grant of any
scholarship award from the Fund shall be applied
only in the field of science, mathematics,
engineering, and such other areas in the
undergraduate or post graduate courses as may be
provided for in the rules and regulations to be
promulgated by the DOST and Department of
Education, Culture and Sports ( now Department of
Education), provided, however, That in the
granting of financial assistance, the
availability of fund, purchasing power of the
peso rate of financial assistance given under
other government scholarship programs must be
considered.
17Section 7. Assistance to grantees- The grantee of
the scholarship program under this Act is
entitled to financial assistance which may
include tuition and other school fees, outright
grant for prescribed textbooks and essential
school supplies, outright grant for prescribed
military science and physical education uniform,
transportation expenses and monthly living
allowance Provided, however, that in the
granting of financial assistance, the
availability of funds, purchasing power of peso
and rate of financial assistance given under
other government scholarship programs and must be
considered.
18Section 10. Distribution of Scholarship Slots-The
DOST in line with this Act shall provide for the
proportional and equitable allotment of slots for
identified fields of science and technology to
attain a balanced distribution of manpower in
terms of number and expertise. The DOST shall
organize a program geared towards enlisting at
least two (2) scholars for those congressional
districts without municipality. Qualified members
of the cultural minority in appropriate cases
shall be given due preference.

20REPUBLIC ACT NO. 8248 AN ACT FURTHER
STRENGTHENING THE SCIENCE AND TECHNOLOGY PROGRAM
OF THE GOVERNMENT, AMENDING FOR THE PURPOSE
REPUBLIC ACT NO. 7687, OTHERWISE KNOWN AS THE
SCIENCE AND TECHNOLGY SCHOLARSHIP ACT OF
1994 Section 1. Section 4 of Republic Act No.
7687, otherwise known as the Science and
Technology Scholarship Act of 1994, is hereby
amended by adding sub-section 4-A to read as
follows
21- Section 4-A. Science and Technology Human
Resource Development Council.- A Science and
technology Human Development Council is hereby
created which shall be chaired by the Secretary
of the Department of Science and Technology and
shall be composed of the following - The Chairman of the Commission on Higher
Education ( CHED) - The Secretary of the Department of Education,
Culture and Sports (DECS) - The Director- General of the Technical Education
and Skills Development Authority (TESDA) - The Secretary of the Department of Budget and
Management (DBM) and - The President of the Philippine Association of
State Universities and Colleges (PASUC)
22- The Council shall perform the following
functions - Coordinate science and technology human resource
development programs - Formulate a medium and long term science and
technology human resource development plan in
accordance with the national medium- term plan - Formulate policies for the allocations of science
and technology scholarships - Formulate broad policies on advanced degree
programs for science and technology - Formulate a career system for technologists and
technicians to complement the scientific career
system - Formulate programs to train and retrain
scientists, engineers, researchers and
technologists and encourage them, through various
incentives, to return and practice their
professions in the Philippines, to enhance and
accelerate the technological development of the
country and - Perform other functions necessary to effectively
implement the provisions of this Act.
23REPUBLIC ACT NO. 8439 AN ACT PROVIDING A MAGNA
CARTA FOR SCIENTISTS, ENGINEERS, RESERACHES AND
OTHER SCIENCE AND TECHNOLOGY PERSONNEL IN
GOVERNMENT Section 1. Title- This Act shall be
known as the Magna Carta for Scientist,
Engineers, Researchers and ST Personnel in the
Government
24Section 4. Science and Technology Career System-
A career system for science and technology
personnel in the service of the government which
is patterned after the Scientific Career System
(SCS) shall be formulated by the DOST in
coordination with the Civil Service Commission.
25Section 6. Salaries- The existing law on salary
scales of the government employees shall not
apply in determining the salary scale of science
and technology personnel as defined in Section 5
of this Act. A new salary scale shall be
developed by the Department in consultation with
the Department of Budget and Management and the
Civil Service Commission, subject to the approval
of the President.
26- Section 7. Other Benefits. Notwithstanding
Section 12 of Republic Act No. 6758, science and
technology personnel shall receive the following -
- Honorarium
- Share in Royalties
- Hazard Allowance
- Subsistence Allowance
- Housing and Quarter Allowance
- Longevity Pay
- Medical examination
27Section 9. Scholarships and Grants. Science and
technology in public and private sectors shall be
entitled to avail of scholarship benefits and
grants for pursuing undergraduate, graduate,
post- graduate or training courses in accordance
with a Scholarship Program to be implemented by
the Department. Grantees of the program may
study within the Philippines or abroad provided
that the Department shall provide strict measures
to ensure their return to the country to render
the service obligation.
28Section 10. Honorarium for Other
services-Scientist, engineers, researchers,
technologists, technicians and other Science and
Technology personnel shall be allowed to render
consultancy services to the private sector and
shall be entitled to receive such honorarium that
may be paid to them by the private entity
concerned. Such payments shall be over and above
their salary from the government during the
period of consultancy and shall not be considered
double compensation Provided, That the
consultancy work will not jeopardize or adversely
affect the operations or activities of his
originating office Provided, further, That the
Secretary of the Department approves such
consultancy.
29Section 11. Detail to the Private Sector-
Provisions of the existing laws notwithstanding,
scientists, engineers, researchers, and other S
and Technology related personnel who are employed
on a regular basis in the government, whether or
not they are conferred any rank under the
Scientific Career System, shall hereby be allowed
secondment to any private entity whenever such
services are required Provided, That the
duration of such service with a private entity
shall not exceed one (1) year Provided, further,
that the detail or secondment of said personnel
will not hamper or adversely affect the
operations or activities of his originating
office Provided, finally, that the head of the
agency approves such detail or secondment.
30Section 12. Exemption from the Attrition Law and
Civil Service Rule on Nepotism- Appointment of
ST personnel to positions of research assistant
and upwards shall not be covered by the Attrition
Law and CSC rule on nepotism in consideration of
the highly technical nature of these positions.
31Section 13. Provision Against Double Benefits-
ST personnel already receiving the same benefits
under any other law shall not be allowed to avail
of the benefits under this Act unless they submit
in writing their intention to withdraw the
benefits already being received and opt for those
provided hereunder.
32Section 16. Hiring of Retired Scientist and
Technical Personnel- An employee retired under
any existing law, who, in the judgment of the
governing board or head of a research agency,
possesses technical qualifications and the
capability to undertake specific scientific
research activities, may be rehired on
contractual basis without refunding the unexpired
portion of the gratuity and accumulated leave
benefits received by him from the Government
Provided, That no qualified science and
technology expert is available to undertake said
scientific activities.
33Section 19. Congressional Commission on Science
and Technology- There is hereby created a
Congressional Commission on Science and
Technology to review and assess among others, the
state of the Philippine human resources
development in ST, the state of computerization
and information technology in the Philippine
economy and society, and the implementation of
this Act. The Commission shall be composed of
five (5) members of the House of Representatives
and five (5) members of the Senate. It shall be
co- chaired by the Chairpersons of the Committee
on Science and Technology of both Houses of
Congress. Such congressional review shall be
undertaken at least once every five (5) years.
34REPUBLIC ACT NO. 8496 AN ACT TO ESTABLISH THE
PHILIPPPINE SCIENCE HIGH SCHOOL SYSTEM AND
PROVIDING FUNDS THEREFOR Section 1. Title- This
Act shall be known as the Philippine Science
High School (PSHS) System Act of 1997
35Section 2.Declaration of policy- The State shall
give priority to Rsearch and development,
invention, innovation, and their utilization and
to Science and Technology education, training and
services. It shall support indigenous,
appropriate and self- reliant scientific and
technological capabilities, and their application
to the countrys productive system and national
life. To achieve these, the State hereby
establishes a Philippine Science High School
System that will assume a leadership role in
secondary level science and technology education.
36Section 3.Objectives- In implementing the
foregoing policy, the State shall pursue the
following objectives a. Integrate the existing
PSHS at Diliman, Eastern Visayas, Western
Visayas, and Minadanao into one system of
governance and management b. Ensure uniformity
in quality standards and systematize operations
of schools under the PSHS System and c.
Rationalize the establishment of science high
schools as defined in this Act.
37Section 5.Scope- The Philippine Science High
School System shall be composed of the existing
PSHS campuses at Diliman, Esatern Visayas,
Western Visayas and Mindanao and future campuses
which shall be established under this
law. Section 6. Overall Coordinating Authority-
The PSHS System shall be under the administrative
supervision of the Department of Science and
Technology Section 7. Board of Trustees- There
shall be a Board of Trustees composed of the
Secretary of the DOST as ex officio chairman, the
secretary of DECS as ex officio vice chairman and

38Section 11. Funding-The amount necessary to carry
out the initial implementation of this Act shall
be charged against the current years
appropriations of the Philippine Science High
School campuses. Thereafter, such sums as may be
needed for the continued operation of the
Philippine Science High School System shall be
included in the annual General Appropriations
Act. The amount of Twenty million pesos ( PhP
20,000,000) is hereby appropriated to be
included for the initial year of operation of the
System, in addition to the budget of the existing
individual campuses.
39REPUBLIC ACT NO. 9036 AN ACT STRENGTHENING THE
GOVERNANCE AND DEFINING THE SCOPE OF THE
PHILIPPINE SCIENCE HIGH SCHOOL (PSHS) SYSTEM,
AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 8496
40Section 1. A second paragraph is hereby added
under Section 2 of Republic Act No. 8496,
otherwise known as the Philippine Science High
School (PSHS) System Act of 1997, to read as
follows The State shall also ensure that
every region is given equal opportunity to
benefit from the establishment of the PSHS
System. Towards this end, only one (1) PSHS
campus shall be established in each of the
administrative regions of the country.
41Section 1. Section 3 paragragh (a) of the same
Act is hereby amended to read as follows (a.)
Integrate the existing PSHS at Diliman, Nueva
Vizcaya, Camarines Sur, Ili-Ilo City, Leyte,
Lanao del Norte and Davao City is one system of
governance and management Section 3. Section 5
of the same Act is hereby amended to read as
follows
42 Section 5. Scope- The Philippine Science High
School System shall be composed of the existing
PSHS campusese herein mentioned and futire
campusese at Diliman, Quezon City Bayombong
Nueva Vizcaya Goa, Camarines Sur Jaro, Ili-Ilo
City, Leyte Tugbok, Davao City and Balo-I,
Lanao del Norte, shall be known as the PSHS main
campus, PSHS Cagayan Valley, PSHS Bicol Region,
PSHS Western Visayas, PSHS Eastern Visayas, PSHS
Southern Mindanao and PSHS Central Mindanao,
respectively. The Nueva Vizcaya Science High
School, established under Republic Act No. 7622,
as amended by Republic Act No. 8364, is hereby
absorbed by the PSHS System and shall become PSHS
Cagayan Valley Campus
43Section 6. Restriction of the Conversion of High
Schools Into a Philippine Science High School- In
addition to the guidelines/ criteria that may be
established by the PSHS Board of Trustees in the
establishment and operation of Philippine Science
high schools, the conversion and inclusion of
existing high schools into the PSHS System shall
not be allowed.

46Section 2.x x x x x x it is hereby declared
a policy of the state to devise a program for
exceptionally able and highly motivated
employees, preferably age 30-40, from the
government, the private sector and/ or the self
employed to undertake advanced studies in a
branch of science, technology or related fields
of learning on which depends the development and
progress of the country. As such, it shall
provide for fellowships to enable them to pursue
advanced studies or research in their filed of
expertise.
47Section 6. Number of Pensionados and Length of
Grant. There shall be selected twenty- four hour
(24) fellows annually- three (3) fellows for each
priority discipline/ industry field of the eight
(8) vital disciplines or areas of specializations
identified by the CHED in consultation with the
NEDA as frontiers or new areas essential for
pushing the economic and social development
thrusts of the country. The scholarship shall be
for one year only.
48- Section 10. Assistance to Grantees- The
Pensionados is entitled to the following
benefits -
- One year leave with pay, including allowances and
other benefits - One economy round-trip air fare to and from the
host country plus other travel expenses required
to foreign travel - Clothing allowance to be determined by the
secretariat - Monthly stipend while on study abroad, of such
amount to be determined by the secretariat - Books/ Instructional Materials/ Research
allowance of such amount to be determined by the
secretariat - Health, Travel and Insurance fees of such amount
to be determined by the Secretariat.

country, a poor but deserving student who shall
be granted scholarships in science and technology

allowance, and monthly stipend for living
expenses.

66Section 2. Incentives Given the significance of
upgrading technologies and productivity of the
people in pursuit of national economic
development, the Government shall develop and
provide adequate incentives to Filipino
expatriates whose expertise and training can
play a vital role in the industrialization
efforts of the country. Among the incentives to
be provided shall be, but not limited to, the
following
67- Exemption from payment of the travel tax for
grantee - Availment of the privilege granted under Section
105(g) of the Tariff and Customs Code of the
Philippines (TCCP) which provides for the
conditionally free importation of wearing
apparel, articles of personal adornment, toilet

theatrical costumes and similar effects which are
necessary and appropriate for the wear and use of
such persons but not for barter, sale or hire

68- Section 4. Practice of Overseas Professionals in
the Philippines The Professional Regulation
Commission may, upon recommendation of the
concerned Professional Regulatory Board,
authorize the registration without examination
and the issuance of a certificate of registration
and a professional license to any Filipino,
whether or not he has lost his citizenship when
he was overseas, who has been in the practice of
his profession in a foreign country or state,
subject to the provisions of this Act.
69The application for registration without
examination and the issuance of a certificate of
registration and a professional license may also
be granted to any Filipino who, prior to his
departure abroad, has already been granted
certificate of registration and a professional
license, by appropriate Philippine professional
regulatory board to practice his profession, but
said registration or license has expired while he
was overseas.

75Section 3. Computation of allocation The gross
domestic product to be reckoned in reaching the
annual budget for research and development for a
particular calendar year shall be the GDP of the
preceding year. However, should the countrys GDP
decrease, the annual budget for research and
development shall be pegged at the GDP level
before the decline. Section 7. R D
Appropriations The appropriations pertaining to
RD in the natural, agricultural, technological
and engineering sciences for various departments,
bureaus, offices, agencies and state universities
and colleges (SUCs) within the National Science
Technology Plan (NSTP) shall be released upon the
recommendation of the secretary of DOST. For this
purpose the DOST shall issue the necessary
guidelines for the implementation of this
provision.
76- Section 8. Special Funds for RD A special fund
for research and development to be known as RD
shall be created and constitute from the
following sources - allocation of 1 percent of GDP for RD activities
- all unused RD allocations and
- all income derived from RD activities
- The fund shall be used only for RD activities of
the agency / institute. The STCC shall develop
the appropriate mechanism for the management of
the RD fund.

Education B. Priority In awarding grants
under this Section, the Secretary shall give
priority to applicants that demonstrate the
ability to (1) Provide teacher training
programs that involve participants in hands-on
activities similar to activities that are
intended for students (2) Attract board
teacher participation (3) Use experience
teachers as instructors (4) Provide the
materials required by the activities described in
paragraph (1) but not commonly found in
classrooms, except that not more than twenty
five percent of the funds awarded for each
fiscal year to any organization for a model
program shall be used to carry out this
paragraph and (5) Provide for periodic follow
up activities conducted at minimum during a
6-month period.
