Certification Requirements

• Engine manufacturer required to submit to CARB
  for review and approval
• detailed specifications for all engine
  diagnostics in format prescribed in regulation
• a copy of build specs relevant to OBD compliance
  that are provided to engine purchasers (e.g., MIL
  specs and DLC specs to coach builders)
• Other powertrain system suppliers (transmission,
  hybrid, etc.) required to separately apply for
  OBD certification and submit required
  documentation

Enforcement

• No proposed detailed OBD enforcement test
  procedures at this time
• need more experience with types of testing,
  number of vehicles, etc.
• However, liability for OBD noncompliances can be
  placed on the engine manufacturer, coach builder,
  or other powertrain suppliers (not just the
  certifying party)

• Engine manufacturers liable for recall and/or
  fines under general ARB authority (HSC section
  43105)
• Coach builders and other powertrain suppliers can
  be treated as manufacturers and thus also
  liable under following HSC sections
• Section 43105 - Recall Authority
• Section 43211 - Penalty for Selling Non-Complying
  Motor Vehicles
• Section 43153 - Sale of Uncertified Vehicles
