Title: AGILE Advanced Governance of Information services through Legal Engineering

1
AGILEAdvanced Governance of Information
services through Legal Engineering
2
The problem
  • Given changes in
  • Business goals and organizational principles
  • (Sources of) Law
  • Customer/client demands
  • How to design stable and law compliant services
with maximum adaptability to accommodate an ever
increasing amount of changes in rules and
legislation in an organization driven by demands
    of politics and society?

3
Project Goals
  • Design method plus representation
  • Distributed service architecture
  • Design tools
  • Organisational implementation method
  • In order to manage, control and automate
  • Many different knowledge sources
  • That keep changing
  • Of different owners
  • In dynamic environments

4
Most Important Innovations
  • Represent sources of law independent of services
    and business processes
  • Ontologies
  • Rules
  • Design and represent legal services and business
processes based on models of sources of law
  • Ontology of legal services
  • Explicit links to original sources
  • Explicit links to models of original sources
  • Design methodology that better fits practical
    demands plus tools

5
Representation of Services and Processes
6
Consortium Why these partners?
  • Delft UniversityExperience in multi-actor
    systems engineering, especially in a
    social-technical context
  • INDProblem owner, dealing with political
sensitive law enforcement using a complex IT
    environment
  • IT companySE experience in designing large scale
    adaptive and maintainable systems
  • Leibniz Center for LawExperience in AI Law,
    legal knowledge representation and legal
    reasoning
  • OIInformation management experience in
realizing compliance in many different client
    environments BPM academy

7
Roles of Non-Academic Partners
  • The IT company is responsible for implementing
the SOA and testing the design methodology in the
    pilots.
  • The IND is a thought leader, problem owner and
will deliver experts for validation and
    evaluation of results.
  • Through OI the DTCA are problem owners and will
deliver experts for validation and evaluation of
    results.

8
Why here and now Relevance to society (1)
  • IND is the Immigration and naturalization service
    of the Netherlands
  • The IND is redesigning under architecture (SOA)
its business processes and renewing its
    information systems to be a
  • Customer oriented
  • Effective
  • Efficient and
  • Flexible organization
  • By 2010
  • IND defines one generic business process with all
    decision relevant information, including some
process information, in a rule based service,
    allowing for
  • Customer specific interaction design based on
    rules and legislation
  • Maintaining a managed relation between changed
rules and the configuration of the case
    management and other services
  • Automation of decisions based on rules and
    legislation
  • Profiling based on experience and national
    security
  • Easy Maintenance of rules and legislation
  • Management of changes and validity of rules and
    legislation
  • Quick changes in response to political demands or
    national security

9
Why here and now Relevance to society (2)
10
Impact on industry and society
  • The IND innovation is by far the largest
implementation of a rule based service in scope
and depth (methodology for distinguishing between
ontology and rules in law) and integration of
rules and case management based in an SOA.
  • Therefore this can be seen as a pilot for all
rule heavy and volatile organizations that can
only survive by being agile and compliant, such
    as financial institutions, multinationals,
    healthcare organizations, insurance companies,
    governmental organizations and their agencies.

11
Conclusions
  • Scientifically relevant research in software
    engineering and computer science law
  • Builds on existing and emerging Semantic Web
    standards
  • Tackles urgent organizational and societal
    problems
  • Using real life pilot cases
  • With strong collaboration between academic,
    business and client organizations

12
Most Important Innovations
  • Build on Semantic Web technology, but specialize
    and extend for law
  • A knowledge representation formalism for law
  • A methodology for distinguishing between ontology
    and rules in law
  • A description of legal services
  • Integrating legal reasoning with other control
    mechanisms (e.g. business processes, experiences,
    feedback/feedforward loops and adaptive cycles)
  • Explicit linking of representations to sources of
    law

13
Complex Adaptive System
  • Classical system CAS
  • Persistent hierarchy emergent bottom up
  • Fixed relationships complex connectivity
  • Regulated process difficult network structure
  • Stable feedback loops boundaries questionable
  • Defined, causal relations
  • CAS
  • Open, non linear dynamical system
  • Adapt and evolve in process of interaction with
    environment
  • Reflexive
  • Governmental work better fit with CAS perspective
  • Political need for adaptive systems
  • Need for new design principles, implementation
    methodologies, architectures, orchestration
    approaches

14
Most Important Innovations -2
  • Methodology and tools
  • Governmental work better fit with CAS perspective
  • Political need for adaptive systems
  • Need for new design principles, implementation
    methodologies, architectures, orchestration
    approaches
