I-601A Provisional Unlawful Presence Waivers

• The Secretary of Homeland Security has
  established a process that allows certain
  individuals to apply for a provisional unlawful
  presence waiver before they depart the United
  States to attend immigrant visa interviews in
  their home countries.
• Under current law, immediate relatives of US
  citizens who are not eligible to adjust status in
  the United States to be lawful permanent
  residents must depart the US and obtain an
  immigrant visa from abroad.

• Individuals who have accumulated more than six
  months of unlawful presence in the United States
  may obtain a waiver of the unlawful presence
  inadmissibility bar before they can return to the
  United States after departing to obtain an
  immigrant visa.
• Under the provisional waiver process, certain
  immediate relatives who depart the United States
  for consular immigrant visa processing may apply
  for a provisional waiver before they leave for
  their immigrant visa interview outside the
  country.
